Show Before Judge Judd at Prove After being out for eight hours the jury in the case of the People Jerry Patnode Alex Dutric and Traffics Dutrie came into court with a verdict finding Patnodo and Alex Dutrie guilty of murder in the second degree and discharging Treffles Dutrie The trial though dull in the main was a hardfought contest The testimony on the part of the prosecution went to show that Isaac Preston and Thomas Stokes were the claimants of a tract of land in Millard county around which they had built a wire fence Part of the land was also claimed by the Dutril brothers with the result of a great deal of bad blood between the parties Last July Preston had cut and cocked the land the hay on a part of in dispute when the Dutrie bo sand s-and Patnode who was working for them cut the fence and for one day hauled hay from the field without any interference in-terference from Preston who was also hauling hay Both parties were armed all this day Prestons wife accompanying him into the field to carry his gun That night about 10 oclock Noakes who had been away during this time returned ancLcalled Preston up the two going down into the disputed field for som horses belonging to Noakes taking a quilt along with which to make Noakes a bed in the field for the night that he might be near the horses Noakes having started out first kept ahead all the way and when Preston reachedan opening open-ing in the willows through which the horses were to be kept from passing he stopped and began spreading the quilt on the ground Just as he was on his knees spreading the quilt he heard a shot fired followed by two more in quick succession At this he ran and called some neighbors who found the body of Noakes lying twelve feet from the cabin in which the two convicted men were camping for the night The theory of the defense was that defendants de-fendants were camped in the cabin of the Dutries to the knowledge of Preston who with Noakes was there for the purpose of killing them It was held by the defense that Noakes fired the first shot after having hav-ing crept up to the cabin door and that the killing was done while Noakes was retreating retreat-ing that both Preston and Noakes were disguised The jury however were unable una-ble to see it Sentence will be passed March 23 OTHEU BUSINESS Pamelia Young vs Win Mellor et al an order was entered amending the complaint People vs Luther C Palmer grand larceny lar-ceny the defendant will be arraigned March 13th U S vs Andrew Rasmussen unlawful cohabitation a plea of guilty was entered and the defendant was given fifty days and costs U S vs Beulah Chipman the defendant was arraigned on a charge of fornication I and entered a plea of guilty As the court was about to pass sentence the prosecution reminded His Honor that the defendant is the supposed wife of Bishop Wm M Bromley at which the court expressed the wish that Mr Bromley instead of the defendant de-fendant were in court His Honor told defendant de-fendant to go home and from now on lead a virtuous life Sentence was suspended United States vs Rosena Singleton continued con-tinued for the term As the clerk was calling out the names of witnesses in the case of E A Billington Luke Burdick one of the witnesses being under the influence of liquor answered louder than the court thought decorous and Mr Burdick was ordered imprisoned for one day for contempt He came out today a soberer and it is to be presumed a madder mad-der man United States vs Hans Nielson the defendant de-fendant made application for a writ of habeas corpus denied United States vs Alice Hart fornication a plea of not guilty was withdrawn a plea of guilty entered and sentence suspended People vs E A Billington in progress Mr C J Smith traveling salesman for Belford Clark Co Chicago had the mis ortune to sprain his wrist most severely I was suffering great pain ho says and my wrist was blly swollen a few applications appli-cations of Chamberlains Pain Balm re ievbd the pain and reduced the swelling in one night and in consequence my business was not interrupted for which I am very grateful I can recommend Chamberlains Pain Balm from personal experience Sold by Z C11 I drug department |
