McGwire's, Mc-Gwire's, at 223 Twenty-fifth" street, was referred to the license committee, on motion of Councilman Dana. The estate of Thomas Aehby was granted permission" to-transfer ft cer-tain cer-tain cemetery lot to the purchaser thereof. A petition was received from residents resi-dents In the Third .ward, alined by Leonard Keefer, ct al., asking that some action be taken by the city to protect the land east of the O. S. L. bridge from floods from Ogden river. Several of the petitioners were present pres-ent and addressed the council upon the subject In hand. Councilman Thomas was in favor of the city's abandoning the work started a short time ago, to relieve the danger from floods In the district named, and stated that the more the city did, the more they become involved in a matter, mat-ter, which was not strictly a civil affair. He moved that the work bo abandoned, and was supported In tho idea by Councilman Dickson. Councilman Flygaro moved -to amend by referring the matter to the street committee, city engineer and city attorney. Mr. Flygarc advocated doing what as possible In the matter and was supported by Councllmen Dana. Humphrls and Powers, each of whom spoke on the subject. City Attorney DeVine stated that he was not in favor of the city taking up tho matter of changing the course of Ogden river, as contemplated, as he consider! that any damage arlR- ing from said change would make the city practically liable as trespasser upon up-on land over which it had no Jurlsdlc- tion. Cooper, et al., residents on Tbirty-Drst street, east of Washington avenue, asking that the district be declared a sidewalk side-walk district, was referred to the sidewalk committee. A petition from E. I The matter was discussed at some length before an understanding was arrived at, during which an amendment amend-ment to the amendment by Councilman Council-man Peery, that the council, as a committee com-mittee of the whole, visit the park and examine it, was loBt. Mr. Thomas' original motion was then carried. A motion by Councilman Thomas to have the city sprinklers painted, was considered, and the water committee was instructed to obtain bids tor tho work. The City Council met in regular session last evening, nine members being present, and Deputy Recorder Miss Hancock acting as clerk. The ordlnance.granting the Oregon Short Line permission to build a spur of track from Gamble-Robinson Co., came up for Its third and final reading. read-ing. Sncclal claims for current exnonses. amounting to $2,254.28, were allowed on motion. A report of the street committee, recommending that an Indiana gnd-er gnd-er be ordered through the Hutton Implement Im-plement company, was adopted, on motion mo-tion of Councilman Thomas. A report of the committee on lights, recommending that arc lights be provided pro-vided at the corners of Jefferson and Seventh street, and Monroe and Seventh street, was adopted, on motion mo-tion of Councilman Thomas. The report of the sanitary committee commit-tee was ordered filed. The report of the railroad and street committees, the city attorney and city engineer, In regard to the petition of Robert C. Carr, et al , asking that action be taken In connection with tho railroad grade being constructed by Simon Bamberger in the vicinity of Thirty-second street and Wall avenue, ave-nue, recommended that no action be taken as an investigation of the matter mat-ter showed that all work referred to was being done by the company on Its own ground.
