'' BINGHAM, Dec. S. Kapheal Lopez is still in the Apex mine. This iB def K initcly established in tho minds of th" B men who searched until 3oJclock this morning after running onto a clew that indicates almost beyond reasonable doubt that Lopez is thero and probably Ik alive. A battle with the bandit is os- tt pectod before evening. Shortly boforo midnight last night K tho searchers went into a atope known K as "No. 5, leading off from the Andy K tunnel a short distance beyond the in- Hi clino whero the shooting took place. ( Thero thoy found the desperado's bed 111 and severnl of his effects, including H his coat. Tn Xo. 7 stopo a fow minutes l later his scarf was found. In tho Andy III incline, almost at the scene of tho l H killing of Hulsoy and Mandorich two 111 gunny sacks, which tho Mexican had ) tied around his shoes to protect the'm II fTom the mud, wore discovered. Mud on ; I tho sacks was still wot. Some of the K I searchers wero inclined to boliovo that W H Lopez had thorn on last night or yes- i torday afternoon, although it is known jj that tho mud would dry very slowly III in the damp mine. If I Most Important Discovery. II In the Ko, 5 stope, tho most important l discoveries were made. Hero there l was a rod flowered quilt, a towel, a jl brown coat with, brown stripes in it PI and a gunny Back, Lopez had evident- jjl ly departed in haste, perhaps because jjl his pursuers wore getting close. The III towel was covered with soot. The H Mexican had cvidoutly wiped his face H with it Tho fold oC tho quilt indi- ll catcd that, ho used half of it to lie II H on and the other half to cover him, HI with the towel under his head for a .H pillow. Ho may. havo carried food in ' tho sack, although it was ompty whon found. A littlo later tho rod and gray II H scarf wus found in the No. 7 stopo '( noarby and close to whore the Andy incline runs into tho tunnok l Late this afternoon the bulkhead on j the Phoouix No. " was removed by a , posse consisting of Sheriff Andrew li Smith, Jr., Superintendent V. S. Rood of the'Apox mine, Doputy shoriffs It. j L. Eddington and C. Ls Schcttler and !H Charles Gebhardt. -Footprints in the lH soot deposited by tho rocont smudge j were found leading directly up to tho lijH bulkhead. From -there it appeared that thoy led back into a nearby stope. j Lcadinjr off from tho stbpc were two lljjH (Continued on Page Tour.) R LOPEZ KM TO BE 1 THE APEX Mil (Continuod from Pago One.) holes, in oithor of which tlio man be-lioved be-lioved Lopez might bo lurking. After a hurried consultation Sheriff Smith decided that if Lopoz was in tho holes alivo that it would bo suicido to permit nuy of his mon to investigate. After calline into tho stop to givo tho bandit a chance to Btirrendor if still alive and receiving uo answer tho sheriff sher-iff ordered the dynamite discharged. It will tako several hours this morning to dig into the ruins to discover whether tho charge blew Lopez into eternity. During one of tho fast searches be-' fore tho posse retired until morning, an incident occurred which mado tho searchers momentarily beliovo they had run onto Lopez and that ho was ready to begin his lust light. As the posso was going down through tho Andy in-elino in-elino l'rom the Minnie tunnel to the Andy, Charles Peterson, a guard, stationed sta-tioned at the mouth of the incliue in the Andy tunnel, fired a shot from hia revolver. lie said afterward it was accidental. ac-cidental. Effect is Electrical. Tho offcot on tho posse was electrical. electri-cal. A. G. Eobiuson, who had boon showing tho men where ho and Cortello got- the boodles of Hulscy and Maudor-ich, Maudor-ich, jumped back toward a hole for safety. It turned out to be a 12-foot shaft into the hoist engino room below. Itobinson wont down, severely lacerating lacerat-ing his hand, injuring his left kneo and boingggonorally bruised about tho body. Indointnablo ho got up and continuod tho search until tho party quit at. 3 a. in. ICvory m'otnber of the posse was certain thnt Lope?, had beon found and jumped for protection before o polling firo into tho blacknoss bolow. Peterson Peter-son was Boveroly reprimanded for his carolossncss. Whon tho BearchorB quit this morning they felt certain that Lopez, nftor abandoning his bed, hud dronpod down through tho Andy incline onto tho -100 level. From thoro he may have gone to tho oOO, tho 700 or tho Phoenix, where tho stopo was dynamited yesterday af-tornoon. af-tornoon. Believes Bandit is Dead. Dr. F. E. Straup expressed hia beliof last night that Lopez is dead. Ho said ho behoved that tho stopo whoro tho bed was found had boon abandonod because be-cause Lojpez woke up to find fumes rushing in on him, had hastily wiped the soot from his face and ran tor safe-' ty from tho smoke. In such an evout ho could not have gone far, believes Dr. Straup, without fainting from tho fumes. It is considered possible that, ho might have reached tho Phoenix bulkhead and then dropped back into the stopo that , was dynuhiitcd. Tho soarchors who went in yesterday aftomoon and who made the latest and important discoveries wero S. S. .Tones, tho fearless guido of tho party; Dr. F. 13. Straup, Dr. David Ray, Ray Claycs, Guy Do Ford, Sheriff Philip Abets, George Rucker, Goorgo Chandlor, George Robinson, A. G. RobinBon, J. D. Cortello and F. V. Fitzgerald of The Tribuno staff. Tho party went to tho back of tho Andy tunnol first and on tho return trip searched every stopc, raise, incline and hole on tho "level. It was whon tho mon searched the No. 7, near the Andy incline that tho discovery of the bod was made. A few minutes later others in tho party found the scarf in No. 5-and then the gunny sacks off the bandit's feet in tho incline at tho sceno of tho shooting. Ajq important feature of the discovory was the announcement of Robinson ana Cortellc that they, with Deputy Sheriff Julius Sorenson, had been through the same stopo Saturday afternoon and had found nothing. Tho mon Baid, however, that in tho dim light it was just possible pos-sible that thoy might have overlooked tho bandit's erfocts Saturday, although they did not coneidor it likely. To Resume Work Today. It is probablo that little will be done in the way of searching today until the men who worked until 3 oclock this morning can get back and continue it, after getting a few hours of sleep. Thoy know where thoy have been and what has beon found aud it is believed that they can do more effectivo work by completing tho work themselves. Before chcy left tho Andy tunnel shod this morning thoy carofully instructed in-structed tho guard at tfio Andy incline to watch their position closely in order that the Mexican can iavo no chanco lo slip back up into tho regions that havo been searched. Thoro is no place above tho Andy tunnel now that has not been carefully inspected, except a small portion of the York tunnel, which will bo oxaminod early this morning. The men believe, howevor, that Lopez is in ono of the lower lovols if ho was not killed by the explosion, and they will work ou that theory as soon as thoy return to tho mine. Explosive Is Prepared. After Sheriff Smith aud the others had discovered tho footprints leading back from the bulkhead into the stopo, from which there were two holes lead iug back and into which it is bolicvod Lopoz might havo taken refuge, preparations prep-arations were made for dynamiting. When tho dynamiting expert had prepared pre-pared tho two charges, Sheriff Smith stoppod. into the stope to givo Lopez an opportunity to surrender if ho was there. "T am the sheriff of Salt Lako county' coun-ty' he said. 'I call upon you, Raphael Ra-phael Lopez, to surrender. If you do not you will bo dead in thirty minutes. I call upon you to surrender once. 1 call upon you to surrender the second time. For "tho third and last time I call upon you to surrender." Tho others in the posse stood silontly listening for a minuto or two. The sheriff listened intently for an answer. Bjit no reply came from tho inky darkness, dark-ness, where it was believed Lopoz might bo in biding. Then the sheriff turned to tho dynamiter dyna-miter and ordered: ' Throw in your dynamite." "Within a few seconds thero was a deafoning report, followed by another. It was necessary for tho posse to remaiu oulsido for more than nn hour while tho smoko hung in the stopc. As the charges displaced an enormous amount of rock and gravel, it will tako some time to dig into tho holos and stope. It may bo morning before it wil bo definitely known whether Lopoz was in the hiding placo. Strength was added to tho beliet that Lopez might be in tho stope, because it was at the Phoenix bulkhead that guards roported having heard a pounding pound-ing on the inside early' in the week. The guards said that po'unding sounded as though it was being made with steel tools, and it was believed at the time that Lopoz might be making an attempt to placo a charge of dynamito to blowout blow-out the bulkhead. |
