The Supreme court handed down an opinion Friday in an action 'entitled, "In the matter of the estate of C. A. Bedford; Commercial National bank of Ogdcn, appellant; ap-pellant; Amelia O. Bedford et al., respondents. re-spondents. Ten years ago, after the death of .Mrs. Bedford's husband, certain real estate was set aside for .Mrs. Bedford and her minor son. as a homestead, and at this I time a number of debts were left unpaid, one debt of 3500 being due to the Commercial Com-mercial National bank. JLater I he estate was entirely closed up. ! In 3U07 Mrs. Bedford sold the homestead home-stead for $-1300 and the bank attempted to collect Its 5500. upon the ground that j the title to tho homestead did not vest entirely in Mrs. Bedford, but that she was only entitled to an Interest of $250, ; the amount of the exemption under the j statute, and that the remainder should I be applied upon debts owing by the es I late. j The lower court held thai the whole of the property belonged to Mrs Bedford, ; and this view Is upheld by the Supreme court. The judgment below is accord- I Ingly affirmed. |
