Show , S DUP COURT FIGHT CONTINUES ON PIONEER MEMORIAL Attorneys for the state and Daughters of Utah Pioneers Tuesday Tues-day asked that the state supreme court "promptly deny" a petition by James Rolla Thomas, 331 . . . Main, asking: a rehearing of his attack on the constitutionality of the proposed Pioneer Memorial building. The high court upheld the constitutionality con-stitutionality of legislative appropriations appro-priations for the building recently in a 3-2 decision. In their brief, the DUP pledge that when the state fulfills its part of the agreement to construct the building on the plot of land leased to the organization for 99 years, that their valuable historical histori-cal collection and extensive display dis-play of relics will remain in the building forever." The D U P brief took issue with Mr. Thomas on his argument that the legislature by appropriating funds for the building ha3 granted the organization a special franchise. fran-chise.
