Show OPA RENT DIRECTOR 4 GIVES ADVICE ON REGULATIONS Landlords in Utah's rent control area were cautioned Wednesday against circumventing OPA tenant ten-ant eviction restrictions, but at the same time were advised that the regulations permit eviction of tenants on several grounds, by Glen D. Reese, OPA district rent officer. Numerous complaints have been received by the rent office alleging alleg-ing landlords have asked tenants to move so the owners could occupy occu-py the accommodations, Mr. Reese said. However, the landlords have then failed to move in and have shortly re-rented to other tenants. Because of the frequency of this particular complaint, OPA officials offi-cials surmise that in many instances in-stances the landlords have not acted in good faith and have thereby there-by violated the rent regulations. In outlining the proper procedure proce-dure for removing a tenant, the rent officer stated that OPA rent regulations establish seven grounds upon which tenants may be required re-quired to move: remodeling; personal per-sonal occupancy by the landlord; non-payment of rent; tenant failure fail-ure to renew the lease; tenant refusal re-fusal of access to the landlord; violation of tenancy obligations or for committing a nuisance; expiration expi-ration of a tenant's lease may cause removal of sub-tenants. However, in all such cases the landlord is required to set forth the cause for the removal in the tenant's notice to vacate and file a copy at the area rent office. Reese stated also that removal of tenants may be authorized by his office on additional grounds. He urged landlords who feel they have reasonable cause for eviction of tenants, even though they may not be specifically mentioned in the regulations, to consult with the area rent director. "We have no intention of allowing al-lowing the regulations to be used as a shield to protect either land- lords or tenants who refuse to abide by reasonable standards of conduct or who fail to abide by their rental agreements," Reese continued. "At the same time, it must be made clear to all concerned con-cerned that we will not countenance counte-nance circumvention of the regulations. |
