Show constitution AGAIN TO RESCUE for a number of years there has been a determined fight waged by such organizations as the consumers welfare league led by progressive senator herbert M maw to prevent utility companies in this state from maintaining one capital structure as a basis for taxation and another two or three times as great as a basis for determining rates for their service in the 1937 legislature this fight crystallized into the of what is known as the maw act setting up a new basis for tax assessment of utilities which would be fair and equitable the utility companies attacked the constitutionality of the measure in the courts and the su preme court of the state last week handed down a four to abne decision declaring the act to be unconstitutional the act was invalidated upon the ground that it cont contained affied an unconstitutional transfer of the power to assess utilities from the state tax commission to the public service commission thus once more the good old dependable constitution is is employed by the special privilege group to perpetuate their graft of avoiding avo iding just taxation while compelling a L long suffering public to pay rates on watered stock j no wonder these special privilege concerns do every i thing athing possible to preserve and immortalize the sanctity of our state and federal constitutions since they are the stockades behind which predatory wealth takes refuge when an outraged citizenry attempts to throw off the unfair dis crimination which is imposed by these beneficiaries of spec ial privilege i our constitutions can always be depended upon to rei strain the interests of the majority but they did not pre vent the theft of our oui birthright bequeathed by the conati t aution to the people of the united states through their i congress to issue and regulate our specie and medium of exchange which was sold or given to private banking in te rests through the national banks law and the federal reserve system and which amounts to a loss to us of scores scores of billions of dollars but the courts find nothing ancon in these laws since they are framed in the interest of special privilege |
