Show litigation OVER ffitch HIGHT ENOS IN compromise equitable basis found for distribution trib ution of the sevier river waters all of sevier and millard counties and parts of sanpete and piute diute counties are greatly and it is hoped favorably affected by a compromise which was ivas reached last week between the sevier river waler users on the upper and lower river the compromise reached will do away with all further litigation and in this way a content contention ign has been settled which was in the thee eyes yei of the public and in the hands hand of the courts for nearly twelve years salt lake dailies announced that a com compromise had been reached but the parti particular C cula 11 1 sei rs were not given in any ag of the articles published in salt lake city and sortie soine weekly papers ot of the state we therefore took pains to interview the president of the piute diute reservoir irrigation co S al M jorgensen of salina who during the negotiations for a final settlement was active in the interest of the water users under the piute diute project while several canal and irrigation companies along the river were interested in a final settlement the main controversy took place between tile the sevier bridge reservoir irrigation co of millard county and our plute reservoir irrigation co the sevier bridge go co claimed under the hawley filing an amount of water nearly equal to all the water that the sevier river could furnish a total of acre feet this filing having been prior to the filings of the otter creek reservoir co known as filing no which was later sold to the state and by the state to the piute diute reservoir irrigation co the sevier bridge users claim that filing no is nonexistent non existent had all the water claimed by the sevier bridge co been adjudicated to this company the adjudication would also have adversely affected the primary rights of land owners who had been adjudicated waters under the haggins and morse decrees the compromise will leave the primary rights under these two and some minor decrees anaf ted and of the first water available for storage after the primary lounz have b satisfied the sevier bridge hoi ho re i air S Ii li co will be entitled to 0 o acre feet after this piute diute res arvor irrigation co will be entitled to store acre feet of ti the ie remaining w water ater the sevier bridge co will receive three fourths and the piute diute co one fourth until such a time when a total of acre feet will be stored in the piute diute reservoir of the water then remaining the sevier bridge co will receive acre feet and all the remain water will ill be divided between the sevier bridge and the piute diute companies at the ratio of three fourths for the sevier bridge and one fourth for the piute diute co in years when ample precipitation will cause the river and its tributaries tributa ries to furnish as much water as in the eight years from 1918 to 1925 there will be ample irrigation water for all concerned in dry years however the alie piute diute co might not get moie or even perhaps less than the first acre feet and then mr air jorgensen explains the far danners will have to curtail the use by putting less under cultivation |
