The report said the rental should have a hard surfaced driveway of less than 12 percent grade. It should be accessible by a standard vehicle (under winter conditions) on a roadway of 10 percent maximum slope. The site must also provide adequate parking. The staff said Conditional applications should also meet these standards: The rental will be reviewed for I its comDliance with building code. If site improvements are needed, they will be installed or guarantees should be posted to ensure them. -Management for the rental property will provide adequate maps where needed, arrange for proper garbage disposal, avoid unsightly landscapes and keep buildings in reasonable condition. The staff proposed enforcement measures for any rental properties. The city would keep a log of complaints on rentals. If the city receives over two bona fide complaints in a 30-day period, the Planning Commission would meet for possible revocation on the rental. The Planning Commission will meet next Wednesday at the Marsac Municipal Building officially at 8 p.m. 1 by Rick Brough A new city ordinance may make nightly rental possible in almost all zones of Park City. At the same time, a set of performance criteria will govern the operation of nightly rentals. Those proposals are part of an outline for a nightly rental ordinance suggested by city staff. The Park City Planning Commission will consider the outline at its meeting April io. In a March 22 memo to the commission, the staff proposed nightly rental to be prohibited in only two zones-Light Industrial and Recreation Open Space. At the same time, nightly rentals allowed in other zones would be expected to meet performance standards. For instance, the staff report said rentals should make efforts to mitigate noise impacts. It states, "Numerous or frequent complaints by the neighbors shall be cause for immediate revocation of the ... nightly rental use." In the outline, nightly rental would be a Permitted Use in the following zones: Recreation Commercial, Historic Commercial Business, Residential Medium Density and Residential Development Medium Density. In seven other areas, rentals would be Conditional that is, it would be subject to compliance with review standards and approval from Planning Commission. These zones would include Estate, Residential Development, General Commercial, Master Planned Developments and residential areas zoned as Historic or Low-density. Commissioner Paul Bickmore, questioned the large number of Conditional areas at the March 27 planning meeting. The commission could face a long backlog of rental requests, he said. But staff planner Dave Boesch said Conditional use requests could be handled quickly by being placed on the Consent Agenda. (Under the Consent Agenda, the commission can approve en masse staff recommendations on a number of Conditional-Use items. (An item can be pulled off the Agenda if the commission has a question about it. ) What factors would influence the commission in deciding a conditional use? In the past, commissioners have indicated the consent of the surrounding neighborhood is an important factor. For instance, a joint city councilcommission meeting . concluded a rental applicant should show he has the' support of the majority of neighboring owners. (This was reported by then-planning chairman Cal Cowher, in a Feb. 27 memo.) The group also said homeowner's associations should address rental in their regulations and new subdivisions should declare an intent towards rentals in their recorded plats. More recently, the March 22 outline said "the comments of nearby residents and homeowner's associations will be given careful consideration." Finally, on Feb. 27, the commission approved nightly rentals in the Solamere and subdivision and on 445 Deer Valley Dr. In both cases, the applicants said they had the approval of the surrounding neighborhood.
