Show Harper and Kern were among those subpoenaed to appear before the grand Jury. John Fishburn. president of the National Na-tional Bank of California, was chosen foreman ot the jury. Judge James, In Issuing his Instructions, made It plain to the grand Jury that they were to consider tho acts of men now public officials or who had been public officials, offi-cials, and that no Indictments should be returned against other persons without special instructions from the court. This was to obviate the possibility pos-sibility of the inquiry assuming a partisan par-tisan or political nature. The taking of testimony was Immediately begun. The first witness called wan Joseph Durnnd, an alleged lieutenant of Nick Oswald, the tenderloin property owner, own-er, who fled the city prior to the convening con-vening of the grand Jury and Is now In Tla Juana, Mexico.
