The investigation of the Industrial school by the governor's committee was continued this morning, both Bides having procured counsel which gav.c a legal aspect to the deliberations and which tended to prolong the tak- I TMrv Thomas, didn't you, of jour own ! accord?" In an effort to show "outside talent" tal-ent" to have been used in preparing the affidavit, the attorney asked: "Vo you know what the woid 'clandestinely 'clan-destinely means?" , Witness: "I think it means signing something without being there when it was written." The amusement was general. When asked regarding his statement about taking In food to the boy without with-out the knowledge of Supt. Thomas, the witness stated, that he had slipped slip-ped provisions to the boy without the permission of anyone. Regarding a shortage of food at times, witness told of one time when there was not enough meat, sugar anl beans. , In t;ie matter of the statement by Holmes, that he had not sworn to the affidavit which he signed, the witness finally admitted that he had sworn to. it before a notary as stated in the document, although he thought a formal for-mal oath was one where the right hand was raised. Witness stated; upon being quos- uonco. Thomas on account of being fined $10 for letting the buy escape. Holmes then stated' that the misleading mis-leading statements he had made to the ladies in the affidavit were in regard re-gard to the strap, tho price of stock and the names Supt. Only two witnesses were examined during the entire morning. .Lamonl, Holmes, employed at the Institution In-stitution as barn instructor In 1908 and 1908, was the first to testify. Holmes was asked regarding an affidavit affi-davit previously signed by him, he now refused to swear to. Upon an objection offered by Attorney Johnson, tho affidavit was ruled out as evidence, the witness being present to offer his President Jotseph, Holmes then acknowledged ac-knowledged that he was guilty of perjuryj having felt sore because his wages were not raised before he had quit the Industrial school. Holmes was then excused. John Borger, formerly employed at the school In the barn and painting departments, was the next witness, and testified that he had known boys to have been confined for three weeks in the cell on bread and water diet. He said that he hid, M times, slipped slip-ped the hoys a little food on tho sly and against orders. One boy said that the bread tasted as good as chicken chic-ken after he had gotten "used to it." Witness stated that he had . known times when the open buckets in the cell were not emptied for two days. He described the instrument of punishment pun-ishment as a two inch strap, a foot or more in length and fitted to an oaken handle. Witness stated that he had been dis- , charged from the scliool because bo own testimony. The witness proved to be a most disappointing dis-appointing failure for both sides, not only repudiating his sworn statemont in almost every detail, but doing so in such a weak and evasive mannor as to bring upon him condemnation. The following Is the affidavit sworn to by Holmes: Lamoni Holmes, being first duly sworn, deposes and says: That he was employed at the State Industrial school, in Ogden, Utah, as guard and steward and in other capacities from August 4, 1908, until May 11, 1909. at i which time he voluntarily resigned his position at Bald institution; that while so employed some of his duties were to bring the food to the kitchen that was ordered by the cook's requisition; that the Ice chest or other places where the food for the Inmates was kept was frequently infested by mice and roaches, and that the food furnished fur-nished was Insufficient to feed tho boys and was insufficient to meet I he actual wants and needs of the inmates of said Institution that frequently when one of the boys would take more food, or take it out of his turn, more than the officer in charge thought that he was entitled to. that he was immediately taken from the table and placed at the bread and water table, and afterwards made to work until the next meal on a bread and water diet Affiant further states that during his employment at said institution five head of Holstein stock, four cows and one bull were purchased by Superintendent Superin-tendent Thomas and haf affiant wn had "lost a boy." having trusted the latter to take a car back to the school from down town, the bov escaping at that time. A recess, was then taken until 2 p. m. . At the afternoon session of the Investigation. In-vestigation. John Borger was recalled to the witness stand. That the sanitary conditions of the cell in which the boy was confined were limited to a tin pail, which remained there all day and was not emptied oft-enor oft-enor than once a day.
