Show oo- . NIK TAX CASE IS BEFORE JUDGE AGEE Judge A. W. Agee yesterday overruled over-ruled the demurrer filed by the defendants de-fendants to the plaintiffs amended complaint in the case of the Pingree National bank against the County of Weber and Joseph Storey as treasurer treas-urer of Weber county, The suit is for the recovery of excess taxes, paid under un-der protest by the bank. An amended complaint in the case alleged that, in 1916, the capital stock of the corporation was assessed at more than double its actual value, intentionally, in-tentionally, knowingly and fraudulently, fraudu-lently, and the taxes were paid under protest. The Pingree bank seeks to recover ?5,438.6S taxes paid under protest pro-test for overvaluation.
