Show HAS A BUSY DAY CITY COUNTY AND RAILROAD OFFICERS ON HIS TRAIL he gets out of the county jail on a writ of habeas corpus from tuesdays standard when the district couric convened this morning judge howell at once took up the case of P B habeas corpus proceedings in which were continued from last and after hearing tae testimony or david ajensen clerk 0 the municipal court before whom the warrant charging with being a fugitive from jua alce was sworn judge howell ordered the discharge of the the testimony ot mr jenann was introduced trod to show that the warrant had been sworn out after the papers in the habeas corpus proceedings had been served on sheriff bailey was brought here from perth north dakota by special agent jones of the short line and lodged in the custody ol 01 sheriff bailey of this county arid held by him at the verbal request of the railroad detective when left north dakota it was understood by him according to his story that ho was wanted at palisade nevada to straighten out some irregularities of which he had been guilty while employed as transfer clerk for the short une at that point he having as he admitted taken certain goods which he sold to a merchant by the name who is now indicted in palisade county on the charge of having received stolen goods was led to believe he says that ho could straighten the matter out and for that reason came without papers after being lodged in jail here he thought that all was not as it should be and after consulting an attorney he decided to go no further without the necessary papers being served upon him and the habeas corpus proceedings were the result after being discharged from custody walked the court house to the office of attorney de vine in the eccles building a free man and after a brief conversation with his attorney started to leave tae building while waiting for the elevator to come up to the floor detective pender and sheriff bailey appeared and stepped aboard the elevator with be for the ground floor was reached detective pender baid hawser I 1 have a warrant for our arrest the elevator stopped render and got out and then pender arrested rearrested re upon a warrant issued by T R jewell constable of palisade Saw sers attorney was standing by and requested that pender and come to his office for a moment on arrival there devine demanded to see the warrant upon which his client had been arrested and defective pender stated that he had onla a warrant that had been telegraphed from Fa lisada which was of course insufficient was again a tree man and went to the house of a friend la the city followed by several of the local and railroad detectives while detective render went to judge murphys Murp hys office to swear out another complaint charging with being a fugitive from justice this judge murphy refused to issue on the evidence presented and a warrant will have to be secured from palisade nevada before the man can be taken into custody again in the meantime is being closely watched |
