Show Mayor Glasmann Charges Wilson and Smith, Who Have Been Circulating False Statements Concerning- Him, With Committing the Crime of Criminal Libel Warrants Served and Both Men Are Arrested. Following the filing of a complnlnt charging ihem with criminal libel, R. T Smith and George Wilson, publish-ers publish-ers of a weekly paper which made Its appcaranco in this city about two months ago, were arrested yesterday on a warrant sworn out by Mayor Glasmann. The charge of libel is the outgrowth of articles published In the paper of tho issue of August 26. Mayor Glasmann alleges that the artlofes published were an attack upon his integrity and honesty, and that ho was slandered as a result ot the publication. Tho arrest of the publishers was made by Deputy Sheriff Tom Devlnb and Judge Murphy fixed their bonds at $500 each. George llalverson, lop sontlng the defendants, asked for their release on their own recognizance, but this request was refused by the judge. Tho two men were then entrusted to the custody of Halverson in order that they might go out and secure bondsmen, the attorney bein held re-Sonslblo re-Sonslblo for their appearance In court Later Oliver Hansen and Fred Hansen qualified as bondsmen for Smith, and J. S. Carver and C. 0. Williams for Wilson. "To the Honorable J. D. Murphy, municipal judge and ex-offlclo city and precinct justice of the peace within, and for, tho city of Ogden, county or Weber and state of Utah. "William Glasmann of Ogden Cltv, Weber county, and stito of Utah, upon up-on oath, complains and states that Georgo Wilson and R. T. Smith, whoso other and true names arc to the complainant unknown, of Ogden City, Wober county, and state "or Utnli, did, on tho 25th day ot August, A. D. 1311, at Ogden City, In the county of Weber, and state of Utah, commit the crime of criminal libel, In the manner following, to-wit: "That the said Georgo. Wilson and It. T. Smith, on the said 25th day of August, A, D 1911, at Ogden City, in the county of Weber, and state of Utah, with the intent then and there to Impeach tho honesty, Integrity and reputation of one William Glasmann, and to deprive him of his good name, fame, credit and reputation, and to bring him Into groat contempt, scandal, scan-dal, Infamy aud disgrace, did, then and thero wilfulh, unlawfully, mall-Uciously mall-Uciously and feloniously write and publish in a certain newspaper published pub-lished at Ogden City, Weber county, and state of Utah, and known and det-i det-i ignated as the "Weber County Citizen,'' Citi-zen,'' a falso, scnndalous, malicious ' and defamatory Hbol In the form of a newspaper article, containing divers false, scandalous, malicious and defamatory de-famatory matters and things of and concerning tho said William Glasmann, Glas-mann, nnd of and concerning the private pri-vate and official acts of said William - Glasmann, according to the tenor anil I effect rollowlng, to-wit: Here the complaint reproduces a long article in vhlch it Is- directly ! and Indirectly charged that Mayor Glasmann and all the members of the city council and the city attorney, i Cliff Potter, Dora B. Tophnm. Denny I Smyth, Gus Becker and others entored ' Into a corrupt deal to repeal tho city liquor law passed before the liquor election, and also charges Mayor ' Glasmann with having received money i for alleged support to the cause of the "wots" during the said election, and then follows the complaint as follows "Thereby exposing him. the said William Glasmann, to public hatred. ridlculo and contempt, nnd to the great damage, scandal and disgrace of the said William Glasmann; they, the said Goorge Wilson nnd R. T. Smith, then and there, well knowing tho said defamatory libel to be false, and against the pence and dignity of the stato of Utah and coutrary to the form of the statute in such cases made and provided. "And the bald William Glasmann tho complainant aforesaid, of Ogdon City, Weber county, and state of Utah, for a further nnd- separate count against tho above named defendants, upon oath, further complains and states that the said George Wilson and It. T Smith of Ogden City, Weber We-ber county, and state of Utah, whose othor and true names arc to the com-plalnaut com-plalnaut unknown, did, on the 15th day of September, A. D. 1911. at Og- J den City and in the county of Weber. I and stato of Utah, commit tho crime of criminal slunder, in tho manner I following, to-wit: 1" "That the said George Wilson ami. R. T. Smith, on tho said 15th dar ft Soptembor, A. D. 1911, at Ogden CItf, In the county of Weber, and Htate of Utah, did again libel Wirm.. Glasmann." Glas-mann." ' And then follows tho reproduction of an article published bj said Wilson Wil-son and Smith In which it Is charges that William Glasmann, Dr. II. M Rowc and X. A. Smyth and others were robbing the Fair association. After reproducing tho article the complaint com-plaint continues: "Meaning thereby that William Glasmann, who is designated in said article as "Bill" Is a thief and grafter, graf-ter, and that all the money which has been paid Into tho treasury of the Four-State Fair has been or will be appropriated and converted to the uso of the said William Glasmann, II M Rowo and D A Smyth, who are designated des-ignated in said article as "Bill," "Dock" and "Denny," respectively, thereby exposing the said William Glasmann to public hatred, ridicule and contempt, and to the great damage, dam-age, scandal and disgrace of the said William Glasmann, they, tho said Georgo Wilson and R. T Smith then and there, well knowing the said defamatory de-famatory libel to bo false, against the penco and dignity of the state of Utah and contrary to "tho form of the stat ule in such cases made and provided. "Wherefore, complainant prays that a warrant be Issued for the airest of the said George Wilson and R. T Smith and that they he dealt with according ac-cording lo law. 'WILLIAM GLASMANN, (Signed.)
