Show "UTAH SUPREME COURT OPINION. " ' On Thursday the Supreme Court of this state handed down an opinion to the effect that the liquor law passed by the last legislature legis-lature repealed by implication all ordinances in effect in cities and incorporated towns at the time the slate law became effective. ! 1 Under the opinion of tho court, cities have no power to prosecute prose-cute any violator of the law under cit ordniances passed prior to , May 9, 1911. Lawyers who have read the opinion have, raised the question as i to the right of any city or county to pass measures regulating the liquor traffics, claiming that ib is doubtful whether the state law ( allows the passage and enforcement of a valid ordinance by any . county or city because of the fact that to make ordinances con- ! lorming with the, state law they would have to include provisions - and penalties without the jurisdiction of any save the district courts to .enforce, hence such ordinances would be inoperative nnd invalid. This important question is. not settled, in the opinion handed down by the court- yesterday, because, as the" court observes' Ml is not an issue in-the case at bar, but it is discussed nnd the inference infer-ence is left that' there is g'ravc doubt as to whether or hqt'tho liquor traffic in tho state can be regulated in any way save under the provisions pro-visions of the state law direct and through the agents T)f the state the county authorities, with proceedings m the district courts. ! The decision brings about a condition where these old ' .ordinnanccs must be replaced with new ones if the authorities and courts of lesser jurisdiction than the district courts shall seek to regulate the liquor business. The city administration of Ogden, immediately after the passage pass-age of the liquor lav.-, enacted new legislation in an offort to conform con-form with the state law, but the inference carried in the opinion of yesterday, is that even the present ordinances are not sufficient to assure the successful prosecution of those who violate the restrictions prescribed by the city in its regulation of the liquor traffic.
