Show UNDERGROUND WATER RULES AND REGULATIONS PASSED IN NEW MEXICO RECENTLY Through the courtesy of W. N. White, this office is in receipt of a copy of the Laws, rules and regulation regula-tion affecting the use of underground water of the state of New Mexico. A copy of the rulings of the State Engineer En-gineer of Nevada, reg-arding Underground Under-ground waters, also a copy of a decision deci-sion of the superior court of Arizona, pertaining to the same subject. All of these are of vast importance to the users of underground water here and show the tendency to pass laws and rules regulating the beneficial uses of such waters. Five particular points appear to be emphasized upon which and around which the question revolves. They are as follows: 1. All underground waters are public pub-lic waters and subject to appropriation appropria-tion for beneficial use. 2. State engingeer shall have control. con-trol. 3. All such waters now being used for beneficial use shall be recognized as valid appropriations and are confirmed con-firmed by the law. 4. Law does not apply to stock, domestic or municipal waters. 5. Ten percent of all the users of any district may, by petition, require the state engineer to administer the law in that district. These articles are on file here in this office and may be inspected by any one interested. |
