Show DECISION FAVORS FARMJENANTS At a hearing before Federal Judge Tillman D. Johnson in the federal court at Salt Lake City Saturday morning, June 21, the orders theretofore thereto-fore made by J. F. Tolton, federal conciliator for Beaver county, in the matter of the bankruptcy petitions of Lester Williams, Ruben Jones and Arthur William.-, dispos.-essing farmers far-mers of premise claimed by Jones und Williams and awarding possession posses-sion of the ground to the latter, were vacated and set aide. Lester Williams, Arthur Williams and Jones each claimed an interest and equity and right of possession in ground being purchased by them. The Duluth Land company, owner of the ground, refused to recognize the right of Jones and Williants in it and leased the ground to farmers of their own choosing. These farmers irrigated irrigat-ed the land and have been farming it since early spring . In the meantime, mean-time, Messfs, Williams and Jones each filed a petition under the amended amend-ed bankruptcy law, and Conciliator Tolton then made orders tliat th company's farmers be dispossessed j The lAihr.h Ijind company apppiie.l I over the petitioners. The Duluth Land cmpany applied for relief from such orders to the federal court and, after an extended 1 taring. Inasmuch as suits had been filed by the company against Williams and Jones to test out the right of possession. posses-sion. Judge Johnson ordered that the suits proceed and that the state court determine the legal questions of right ' of possession, and that the decision j of the state court would be conclusive I on the federal court. In the meantime, mean-time, and until the trial of such cases, I the company's farmers stay on the ground and take all the crops. |
