Show ACCUSATIONS UNFOUNDED For some unaccountable reason rumors and accusations accusa-tions have been circulated in Cedar City by many different persons regarding alloped mistreatment of Dr. Wendell Brooksby resulting in his closing down his veterinarian business in Cedar City and moving to another city. Repeatedly the remark "The Planning Commission ran Dr. Brooksby out of town," causing the city to lose a most valuable service provided by his animal hospital, has been heard. As a result of these persistent accusations, James Sandberg, chairman of the Iron County Planning Commission, Com-mission, feels that it is time that the true facts of the situation be aired. Some time ago Dr. Brooksby established an animal hospital just North of Cedar City. The location was select-ed select-ed apparently because Dr. Brooksby felt that city zoning was too restrictive. The operator ol the animal hospital had planned the erection of a new building, partially on the site of the old building, and partially on land to the South of the old building. Because the new county zoning ordinance provided that no new building or addition be closer than 50 feet from the front property line when on a highway or public road, it would have been impossible to erect the building in compliance with that ordinance. The land to have been occupied by the building is triangular in shape with Highway 91 on the front and an irrigation canal at the rear, and censequently the building build-ing could not be erected and provide 50 feet from the building to the property line. ,On October 2, 13 a letter was received by the County Coun-ty Planning Commission from Dr. Brooksby requesting an exemption from the specific requirement that the building build-ing should be 50 feet from the front property line. Mr. Sandberg points out that since such requests must be referred to the Board of Adjustments under planning and zoning laws, and since the county had not yet organized organiz-ed its Board of Adjustments, steps were taken immediately immediate-ly to complete the organization. This was done, and on October 21, the Board considered the Brooksby request and it was approved by unanimous vote, and he was granted grant-ed the right to proceed with his building as requested. This is entered in the minutes of the meeting of the Board of Adjustment on that date. This refutes all accusations that the Planning Commission Com-mission in any way "ran the animal hospital business out of town." |
