Show ORDINANCE AN ORDINANCE AMENDING THE ORDINANCE EFFECTIVE DECEMBER 2.1, 19 IS LEVYING A SPECIAL IMPROVEMENT TAX IN SEWER DISTRICT NO. 2-48 FOR THE rURPOSE OF CONSTRUCTING CON-STRUCTING AND LAYING SEW-ER SEW-ER MAINS IN SAID DISTRICT IN CEDAR CITY. UTAH. Be it ordained by the City Council of Cedar City, Utah: That the ordinance passed by the City Council of Cedar City, Utah December 16, 1918, effective December 23, 1948 levying a tax on Sewer District No. 2-48 in Cedar City, Utah for the purpose of constructing and laying sewer mains In said District In Cedar City, Utah, is hereby amended to read as follows: Section I. That the City Council Coun-cil of Cedar City, Utah docs hereby here-by levy a tax and provide for the assessment of the same upon the property hereinafter described describ-ed in Sewer Extension District No. 2-48 for the purpose of constructing con-structing and laying sewer laterals, lat-erals, including manholes, flush tanks, Y's for connections, for a complete sewer system and against the following described property: Lots 12 to 20 inclusive, and Lot 1, in Block 2, Max N. Lunt Subdivision Sub-division in Cedar City, Utah. Lots 2 to 9 inclusive, Work 1, Max N. Lunt Subdivision in Cedar City, Utah. Commencing 108.6 rods west of a point 41(i.5 feet nortli of the SE. corner of Section 11. Township Town-ship 30 South, Range 11 West, S.L.B. & M. and running south 110 feet; east 113.54 feet; north 110 feet; west 113.51 feet to the point of beginning. Commencing 333.9 feet north of a point 101.72 rods west of the SE. corner of the SWSW',4 of Section 11, Township 3G South, Range 11 West, S.L.B. & M. and running thence east 06 feet; north 76.5 feet; west 66 feet; south 76.5 feet to the place of beginning. Commencing 929 feet west of a point 161 feet south of the NE. corner of the WMiSWW of Sec-tion Sec-tion 14, Township and range aforesaid, and running thence west 292 feet; south 678 feet; east 490.9 feet; north 528 feet; west 198.9 feet; north 150 feet to beginning. Commencing 1311.5 feet south and 996.69 feet west of the NE. corner SWUNWU of Section 14 aforesaid, and running thence west 71.45 feet; south 129.5 feet; east 71.45 feet; north 129.5 feet to the place of beginning. This tax is levied to defray the expenses of digging the sewer trenches, purchasing and laying the sewer pipe, construction of manholes and installing flush tanks, Y's and necessary connections, connec-tions, and the back-filling of the sower trenches and other necessary neces-sary construction expenses for installing in-stalling the sewer system complete com-plete according to the terms of the contract heretofore entered into between Cedar City, Utah, and Chester Parry, Contractor; also for the costs of engineering, inspection, publishing and mailing mail-ing notices, and making the levy, and for the payment to said contractor. con-tractor. The sewer mains have been laid opposite the property above described and in the following named streets. Property assessed on both sides of streets: Second South Street from a point 200 feet west of the center cen-ter line of Third West Street and to Fourth West Street; Eighth West Street between Thorley ave-nue ave-nue and First South Street; Ninth West Street between Center Cen-ter Street and a point 360 feet South of the south line of First North Street; Harding Avenue between Fourth West Street and Sixth West Street: First North Street between Twelfth West Street and a point 233 feet west of the center line of Twelfth West Street. It Is hereby adjudged that the property above described will be specially affected and benefitted thereby to the full amount of the tax levied, and said parcels of land are hereby assessed at an equal and uniform rate in accordance ac-cordance with the linear foot frontage of the procrty affected and above described, and the tax hereby levied and assessed upon said parcels of land Is $3,741.41 for the total costs of construction and materials, plus the actual expenses for engineering. engin-eering. Inspection, publishing and mailing notices, and making mak-ing the levy, or S2.29 per front foot of abutting property, which Is the total abutter's portion of said improvement, and the City Treasurer Is hereby authorized and directed to assess In accord-nnce accord-nnce with the provisions of this Ordinance for the purposes herein here-in mentioned, nil of the above described property. Section II. The assessment list made by the City Engineer of Cedar City, Utah, ns corrected, approved and completed by the Board of Equalization and Review, Re-view, of the property described in Section I, for the purpose of Installing said sewer mains, Is hereby confirmed, and the report of the Board of Equalization and Review to the City Council of Cedar City, Utah, is hereby ratified, rati-fied, approved and confirmed. Section III. Said tax shall be payable in not more than ten (10) equal annual installments from the date this Ordinance becomes effective, with Interest on the whole sum unpaid at not to exceed Sgven per cent per annum an-num until paid, payable annually; annual-ly; one or more of such Installments, Install-ments, In the order payable, or the whole tax, may be paid without with-out Interest within fifteen (15) days after the date this Ordinance Ordin-ance becomes effective; one or more Installments, In the order In which they are payable, or the whole special tax may be paid after said fifteen (15) days and before the first installment becomes due and payable by paying the same with Interest from date of levy to the date such first installment Is due; one or more installments, In the order In which they are payable, or the whole special tax, may be paid on the date any Installment becomes due by paying the amount thereof and interest to the date of payment: default in the payment of any such Installment Install-ment of principal or Interest, when due, shall cause the whole of the unpaid principal and interest in-terest to become due and payable paya-ble immediately, and the whole amount of the unpaid principal and Interest shall thereafter draw Interest at the rate of 10 per cent per annum until the date of the sale of the property assessed, as-sessed, but at any time prior to the date of the sale of said property, prop-erty, the owner may pay the amount of all unpaid Installments Install-ments past due, with interest at the rate of 10 per cent per annum an-num to date of Davment on the delinquent installments and all accrued costs, and shall thereupon there-upon be restored to the right thereafter to pay, in installments, in the same manner as If a default had not occurred. Section IV. It being deemed necessary for the immediate preservation of the peace, health and safety of Cedar City, Utah and its inhabitants, this ordinance ordi-nance shall become operative and take effect Immediately upon up-on its publication.
