Show Manti City Loses First Court Round Judge Erickson of Richfield ren-j ren-j doied a decision here June 2nd which gave this round of the court action of Sanpete County vs Manti City to the County, says the Messenger. Messen-ger. The demurrer to the amended land supplemental complaint which I had been taken under advisement by the court was overruled and the city was given thirty days to answer. ! This action was brought by Sanpete San-pete County against Manti City seeking the collection of $2100 from the latter to apply on the pavement through Manti City. Mayor Madsen promised the payment of this sum to help make up a part of a shortage of $12,000 necessary to contract the Manti Pigeon Hollow road. The state contributed $4,000, the contractor contract-or $4,000 and Ephraim and Manti Cities the other $4,000. The state the contractor and Ephraim City have each paid their portion. Manti City has not paid here portion because Mayor Madsen claims this promise was made by him on the strength of the road commission promising that Manti should get an eighteen foot strip of pavement plus a three foot crushed rock shoulder through the city. The state claims the crushed rock shoulder through the city was ,hot included. The state has collected the $4,000 Ephraim's and Manti's share from the county, leaving it up to the county to collect from these cities. Ephraim has paid, Manti has not, and the county has brought action ac-tion to collect from the city. The city has offered to compromise by retaining enough of the $2100 to install the crushed rock shoulder some $800 and pay over the bal-, bal-, ance, but this proposition has not been acceptable to the county. |
