Notice is hereby given that at a meeting of the board of directors of the Emerald Mining Company, held at its office, above designated, on Saturday, Sat-urday, September 16, 1911, an assessment assess-ment of one and one-half (1) cents per share was levied on the capital stock of the corporation, payable to J. E. Oglesby, secretary of the company, com-pany, at its said office above designated, desig-nated, in three equal installments, as follows: The first installment of one-half one-half cent, payable Monday, October 16, 1911; the second installment of one-half cent, payable Wednesday, November No-vember 15, 1911; and the third in-Istallment in-Istallment of one-half cent payable Friday, December 15, 1911. Be It ordained by tho City Council of Salt Lako City, Utah: Section 1. Section 2. Tho rights and franchise hereby granted are for tho term of twonty-flvo (25) years from tho date of passage and approval hereof, and are granted upon the following conditions, condi-tions, namely: 1st. Said track shall bo laid upon and conform to tho established grade of said street, and if such grade Is afterwards changed by order of the City Council, said grantee shall, at Its own expense, change said track so as to conform to the same. 2nd.' Whenever said Fourth South Street or Third West Street shall bo paved, then said grantee, Its successors succes-sors or assigns, shall pave between tho rans nnu ror a space or two root outside out-side of each rail with tho samo material ma-terial as that used In the street pavement, pave-ment, and all ties shall bo laid upon a ctiment baso of such thickness as shall bo directed by tho City Englneor. 3rd. Tho said grantee, its successors succes-sors and assigns, shall put in and maintain such crossings over such -switch or spur track as shall from tlmo to tlmo bo required by tho City Council, and neither engines nor cars shall bo permitted to stand on either of the streets mentioned in this franchise fran-chise longer than five minutes. 4th. Good and sufficient conduits to convey water shall bo laid and maintained main-tained In good condition, at the expense ex-pense of said grantee, its successors and assigns, in all wator ditches crossed cross-ed by tlio said swltcli or spur track, so as to admit of free passago of water. 5th. Tho said switch or spur track shall bo laid and shall bo operated so as to cause no unnecessary Impediment Impedi-ment to tho common and ordinary uso of streets upon which It is laid. 6th. Said grantee, Its successors or ass'gns, shall gravel and maintain In good condition at the established grade, tho streets along and across which said spur track shall run to within ono and ono-half inches of the top of tho outer rails, and for a distance dis-tance of 25 feet on each side of tho outer rails, subject to tho approval of tho Supervisor of Streets, until such tlmo as olthcr or both of said streets aro paved. 7th. Salt Lako City reserves tho right to rogulato and control the speed of all trains, engines and cars operated oper-ated by tho grantee, Its successors or assigns upon tho spur track aforesaid. 8th. Nothing in this grant shall bo so construed as to prevent Salt Lako City or Its authorized agents, contractors, contrac-tors, person or corporation to whom a franchise may have been or may hore-aftor hore-aftor bo granted, from paving, sewering, sewer-ing, laying gas or water mains, pipes or conduits, altorlng, repairing or in any manner Improving said streets, but all such work and Improvements shall bo done and made with as llttlo Injury as practicable to said spur track and tho operation thoreof. 9th. The said grantee heroin, its successors and assigns, shall, and by tho nccoptance of the privilogos and franchises horeln granted, and In consideration con-sideration of the samo, does bind Itsolf, Its successors and assigns, upon its acceptance of this franchise, to save said city harmless from all suits, claims, demands and judgment whatsoever, what-soever, whether In law or in equity, which shall be asserted, found or rendered ren-dered In any manner whatsoever, against said city for injury or damages dam-ages to abutting property or otherwise, other-wise, by reason of tho granting of this franchise, or by reason of tho operation oper-ation of said spur track; and that the grantee herein, Its successors and as- i signs, will pay tho amount of any Judgment, determination or adjudication adjudica-tion which, In any suit or proceedings may bo or shall be found against Salt Lako City; provided, however, that said grantee, Its successors and assigns, shall have had notice of any suc.i suits, and an opportunity to appear and defend the samo; and said grantee, gran-tee, its successors and ass'gns, shall appear in and defend all actions brought against Salt Lako City for any Injury or damage by reason of tho construction, operation, or maintenance main-tenance of said spur track. 10th.
