Show GARFIELD COUNTY ORDINANCE NO. 2002-1 AN ORDINANCE PRO- HIBITING BURIAL OF -. HUMAN REMAINS ON PRIVATE PRI-VATE LAND OUTSIDE A RECOGNIZED CEMETERY. WHEREAS, the Board of County Commissioners .of the County of Garfield, State of Utah, nas noted an increase in !. families who wish to inter remains of loved ones onprivate ' property in Garfield County; anf WHEREAS, the Board of County Commissioners notes that many serious concerns attend interment of human remains on private lands, including but not limited to health hazards associated with . groundwater contamination, the need of perpetual care and ready " access, and the chilling effect 'such burials have on the sale of . real property within the County " of Garfield, State of Utah; and . ' WHEREAS, the Board of : County Commissioners notes that the County has provided, at " taxpayer expense, numerous well-kept public cemeteries ..located near each community in the County of Garfield, State of ' Utah, and further notes that adequate ade-quate space is available inside , each of these established cemetery ceme-tery districts for burial of human : remains, at a reasonable cost to family members; and . WHEREAS, on this basis, -'the Board of County ' Commissioners of the County of . Garfield, State of Utah, finds it is in the best interest of the citi- zens of Garfield County to pro-: pro-: hibit further burials or human . .remains outside the boundaries of an established cemetery in '.'the County of Garfield, Sate of .Utah. NOW THEREFORE, BE IT ORDAINED by the Board v of County Commissioners of the . County of Garfield, State of Utah as follows: SECTION 1: Definitions: A. "Human remains" means an intact human body, whether embalmed or unembalmed, and does not include ashes from a body that has been cremated. B. "Interment" means burial of human remains whether or not such remains are contained - inside a vault, casket, or other container, under the soil of any parcel of real property. C. "Established cemetery" shall include any cemetery operated oper-ated and maintained under the authority of a cemetery maintenance mainte-nance district established under Utah Code Annotated 17A-17A-2-201, et. seq., and also including includ-ing cemeteries which are established estab-lished on 'the date of this ordinance ordi-nance at Widtsoe and Spry, County of Garfield, State of Utah. D. "Immediate family" means husband and wife and their children. SECTION 2: Burials Prohibited Outside Established Cemetery: From and after the effective date of this ordinance, it shall be unlawful unlaw-ful for any person to cause or permit human remains to be interred or buried on any land lying outside the boundaries of an established cemetery in the County of Garfield, State of Utah. SECTION 3: Exception for Immediate Family: Not withstanding the prohibition contained in Section -2 of this ordinance, immediate family members of a deceased person interred on lands lying outside an established cemetery prior to the effective date of this ordinance may be interred on the same parcel as the member of the immediate family previously previ-ously interred. A person who wishes to be so interred or if deceased, an authorized representative repre-sentative of the decedent, snail first obtain a permit from the Garfield County Planning Commission at least 30 days prior to the date of interment. In order to obtain a burial permit from the Garfield County Planning Commission, the applicant shall strictly comply with and observe the following requirements: A. At least 30 days prior to the interment, the entire private burial plot shall be surveyed by a licensed surveyor; and B. An official plat of the private pri-vate burial lot shall be prepared by a licensed surveyor and shall be recorded in the office of the Garfield County Recorder; and C. A new deed to the property prop-erty upon which the private cemetery lot is located snail be prepared and shall contain a restrictive covenant requiring that the private cemetery plot shall continue in perpetuity and shall be maintained as a cemetery ceme-tery by all subsequent owners of said real property; and D. A safe, all-weather access road over and across the property proper-ty to the burial plot shall be built and a provision inserted in the deed to the property requiring that said access shall be perpetually perpet-ually maintained in such condition condi-tion that it can be easily traversed tra-versed in all seasons by an ordinary ordi-nary passenger car; and E. The applicant shall obtain from the health department a certificate indicating that the proposed burial plot is located more than 100 feet from any culinary water source; and F. The human remains shall be contained within a casket approved by a licensed funeral director and inside a vault approved by a licensed funeral director- and G. Human remains shall be buried at a depth of at least six feet below ground level; and H. Each private cemetery plot shall oe completely enclosed by a fence which is at least 36 inches high; and I. The applicant shall submit a burial application free in the amount of $50.00 SECTION 4: Effective Date. The Board of County Commissioners of the County of Garfield, State of Utah, "has determined that the public health, safety and welfare requires that this ordinance take effect immediately. COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) FIRST PUBLIC HEARING & CONSOLIDATED PLAN PUBLIC HEARING Henrieville Town will hold a public hearing to consider potential projects for which funding may be applied under the CDBG Small Cities Program for FY 20032004. Suggestions for potential projects proj-ects will be solicited, both verbally ver-bally and in writing, from all interested parties.
