Show County Pays Out $14,639.79 In Unpaid Comp To Officers Garfield County has reached a settlement with one former and one current employee of the County Sheriffs Department in regards to claims made against the county under the Federal Fair Labor Standards Act for unpaid comp time which the deputies alleged had been accruing for several years. The settlement agreement will require the county to pay $9,500 to former deputy Kevin Moore for hours accumulated while stationed as a county deputy in the Escalante area. Officer Moore claimed many of the hours reported were a result of working with the training of a .f. i r' ,. '' 'Ic-f,;'"" i ! Bryce Valley High School hosted a basketball tourney "for the fun of it " and to raise funds for team sports equipment. Four teams from four high schools took part: "for the fun of it: Panguitch, Bryce Valley, Escalante and Richfield. police dog after a regular shift of 8 hours had been completed. Officer John Niemann will be paid $5,139.79 with partial payment to be paid from the current budget year and the balance during the next budget year. Niemann will be required to take time off with pay to use approximately 480 hours of time in addition to the time which will be paid in lump sum. Both officers claimed that the hours were approved by former sheriff Robert Judd while the county claimed that merely documenting docu-menting the hours by entering them into the computer did not v " constitute approval. Garfield County Attorney Wallace Lee has worked closely ; with attorneys representing the i officers and with the county insurance carrier in reaching the settlement which is somewhat less ; than the original claims against the county. ! j In approving the settlement I agreement at the regular commis- i sion meeting July 13, the County ' Commission directed Sheriff Than Cooper to take necessary steps to insure that the problem is corrected and that comp time not be allowed to build up without the knowledge of the commission.
