NOTICE OF REALTY ACTION Exchange of Public and Private Lands in Garfield County, Utah U-63293 U-63293 Bureau of Land Management U.S. Department of the Interior The following described lands have been determined to be suitable for disposal by exchange under Sections 205 and 206 of the Federal Land Policy and Management Act sUm (43 CSC 17 16J: Salt Lake Meridian T. 35 S., R. 4 E., Section 12, lots 14 and 16 (containing 3.83 acres more or less). In exchange for these lands, the United States will acquire a hiking trail easement 12 feet wide across private land described as: Salt Lake Meridian T. 35 S., R. 4 E., Section 12, SW4SE4, and Section 13, N2NE4 (containing 1.42 acres more or less). The purpose of this exchange is to acquire legal public access across the private land to areas of public land in the Escalante River Canyons system. The need for this action derives from past and increasing in-creasing public demand for backpacking back-packing on public lands in the Escalante River Canyons and the need for legal access to those lands. Lands to be transferred from the United States will be subject to the following reservations, terms and conditions. 1. There is reserved to the United States a right-of-way for ditches or canals constructed by the authority of the United States, Act of August 30, 1890, 26 Stat, 391,(43 USC 945). 2. All mineral rights in the Bublic lands will be retained by le United States. . i . 3 i; Title transfer will be subject sub-ject to valid existing rights including includ-ing a road right-of-way (U54533), an underground powerhne right-of-way (U-58155), and a water pipeline right-of-way (U-52885). 4. Pursuant to the authority contained in Executive Order 1 1988 and 1 1990 and in Section 206 of the Federal Land Policy and Management Act of October 21, 1976, the patent will be subject to a restriction which constitutes a covenant running with the land that it may be used only for agricultural agri-cultural or recreational develop- mcnt, but not for residential or commercial development. The public land described is hereby segregated from all forms of appropriation under the public lands laws1 including the mining laws, pending disposition of this action.
