Show Escalante Man Enters No Contest To Assault Charge Four of six charges against a 75-year-old Escalante man were dismissed dis-missed in Sixth District Court on Thursday when he entered into a plea agreement with the state. Shurtz entered a no contest plea to a simple assault charge and one count of reckless driving. Beryl Shurtz was originally arrested ar-rested on Jan. 15 when he was charged with three separate felonies (two aggravated assault counts, one against a Sheriffs deputy, and one count of assault by a prisoner), and three misdemeanors. Appearing in court with his attorney, Thomas Rasmussen, on Thursday, Shurtz entered a plea on the reduced charges with the understanding that he would take no legal civil recourse against the county. Judge David Mower stressed that the agreement between Shurtz and Garfield county would have to be based solely on the good faith efforts of both sides. Shurtz was placed on special probation for a year. If, at the end if that year, there has been no violation vio-lation of the law, all charges will be dropped to clear Shurtz' record. |
