The front door, in addition to taking a bullet, also looked like it had been kicked open, and was unhinged, resting against its outer casing. After the first, early morning shooting, Weber County Sheriff’s Office closed off for a time the three major routes in and out of the Valley—Trapper’s Loop, the North Ogden Divide, and Ogden Canyon. According to Lt. Jensen, they did so “in an attempt to locate possible suspects,” but were left emptyhanded. According to Jensen, the roads were closed in the early hours of Sunday morning for a few hours after the call first came in at 2:04 a.m. Later that evening, after the shooters returned, a neighbor, called the Sheriff’s Office at 10:12 p.m. after explaining they heard gun shots. After officers set a stopping and searching vehicles near the bottom of Ogden Canyon to check vehicles Sunday evening, three suspects were arrested after officers stopped a white sedan, owned by one of the suspect’s relatives, that had, according to an article in the Standard-Examiner, Lucas seven people inside, including the suspects, who were shortly arrested after shell casings and a handgun underneath the front passenger seat where Lucas was sitting were found. In an interview with Lt. Matt Jensen, he stated that the relationship between the suspects and those at the house party was still under investigation, and they still don’t know if the incident was gang related. A police report shows that Nyheim William Edmond Lucas, 20, of Ogden Torres was charged in District Court with four counts of felony discharge of a firearm and one count of obstructing justice, all third-degree felonies. Dianah Patricia Torres, 18, of Ogden; and Vance Malik Williams, 18, of Woods Cross, were also arrested in connection with the shootings. Torres and Williams were both charged with one count of riot and one count of obstructing justice— both third-degree felonies. Torres was the reported driver of the vehicle. Lucas is being held in the Weber County Jail on a $50,000 bond, and Williams Williams and Torres are each being held on a $10,000 bond. In an incident the night before, a car was found crashed into a neighboring barn in Eden with the lights still on but the car abandoned. The car was found when the owner of the property came home in the early hours of the morning and found the vehicle to the rear of his property. This zone is intended to be used in areas associated with major recreational resorts. But unless a nightly rental is a specific part of an “apartment cluster” or “condo-tel,” nightly rentals are still illegal in this zone—unless a Conditional Use Permit can be obtained from Weber County. To obtain a Conditional Use Permit requires a formal application process granted through the county’s planning department, which, in part, entails a review from the Ogden Valley Planning Commission, which would then consider the architectural design and onsite relationship and development beyond the boundaries of the proposal, residential density of the proposed development and its distribution as compared with the residential density of surrounding lands; in essence, taking into consideration any anticipated detrimental effects, and applying conditions to minimize them. Commercial Valley Resort Recreation Zone (CVR-1) The purpose of this zone is to provide primarily commercial amenities, facilities, and goods—associated with major recreation resort areas—that are compatible with the general surroundings of the natural environment. Still, a recreation lodge providing nightly rental services is only permitted as a conditional use that, again, needs specific approval through the public review process before the Weber County Planning Commission. As Part of an Approved Planned Residential Unit Development (PRUD) Nightly rentals may be approved in this zone as part of an application and approval of a PRUD where any housing units to be developed or used, in whole or in part, for sleeping rooms (including lockout sleeping rooms) for nightly rentals shall be declared and designated on the site development plan (Section 108-5-4 (d)), and, finally, go through the public process and receive final approval. Ogden Valley Destination & Recreation Resort Zone (DRR-1) The purpose of this zone is to provide flexible development standards to resorts that are dedicated to preserving open space and creating extraordinary recreational resort experience while promoting the goals and objectives of the Ogden Valley general plan. In this zone, the following, related to overnight rentals, are permitted in relationship to nightly rentals: “Nightly rentals of a single-, two-, three-, four-, multi-family dwellings; recreation lodge; lockout sleeping room; detached lockout; condo dwelling unit; condominium rental apartment (condo-tel); private residence club; townhome; residential facility; timeshare/ fractional ownership unit; hotel; bed and breakfast dwelling/B&B or inn/B&B hotel; or accessory portion of any other residential use” (Sec. 104-29-8). If you are already operating a nightly rental home or unit, and are not sure whether it is in compliance with current zoning laws; or, if you believe a neighbor is illegally operating a nightly rental business, you can contact the Weber County planning office at 801-399-8791 for more information or to report the problem.
