Applications for con- ORDINANCE NO. 171 An Ordinance Concerning County Roads and Way, Regulating Excavations, Encroachments, and Structures Within Repeal of Summit County Ordinance No. Rights-of-Wa- y. 99-- BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF SUMMIT COUNTY, STATE OF UTAH. AS FOLLOWS: Section 1. Permits Required for Excavations, Driveways, Encroachments, and Structures tinual bonds shall be made before December 31st of each year and shall be valid for the next calendar year or as deter- -' mined by the Board of County Commissioners. a) It shall be unlawful for any erson, firm, or corporation to place, make, enlarge or change any excavation, driveway, encroachment or structure within y the for any County Road without complying with the provisions of this Ordinance and obtaining a permit as provided for herein. b) It shall be unlawful, and punishable as provided for herein, to make any excavation or to ' place any encroachment or structure in any County right-o- f way not described in the approved permit application or which exceeds in size the dimensions or which does not conform to the conditions described in said application. Section 8. Supervision and right-of-wa- Inspection A representative of the County Commission or the County Road Superintendent shall from time to time inspect or cause to be inspected, all work done pursuant to permits to insure the enforcement of the provisions of this title. Notification shall be given to the inspector at least 48 hours prior to the commencement of any work. The Completion Bond shall not be rel- eased without an inspection made to determine satisfaction of all applicable provisions of this ordinance. Section 2. Emergency Conditions Emergency excavations and Section 9. Failure to Comply In the event of failure on the part of any person, firm, or corporation to comply fully with the provisions of this ordinance in making any excavation, encroachment, or structural in- encroachments may be made without prior permit if the reason for the excavation or encroachment is to prevent loss of life or damage to property which appears to be imminent if the action is delayed by waiting to secure said permits. Section 4. Applications Applications for all permits shall be made to the County Road Superintendent as provided and shall describe the location of the intended excavation, encroachment or structure, the pertinent dimensions thereof, the purpose thereof, the person, firm, or corporation doing the actual work and the name of the person, firm, or corporation for whom or by which the work is being done and shall contain an agreement that the applicant will comply with all ordinances and laws of Summit County and the State of Utah relating to the work to be done. The application shall also provide Section 5. Permits All permits issued pursuant to this ordinance shall be valid for a period of sixty days, except that no permit shall extend into the Winter Season as outlined in Section 3. unless compliance with said section is made. y. 1 1 . Manner of Excavation (I) General excavation shall be unclassified. The applicant shall perform all excavation of every description and of whatever substances encountered, to the depth specified on the plans andor required to accomplish the work. During the excavation operations the material which might be found suitable for use in backfilling shall be piled in an orderly manner a sufficient distance from the banks of the trench for convenience in operating equipment, to avoid embankment overloading, and to All prevent slides and cave-inexcavated materials not required or not suitable for backfilling shall be promptly removed from the site of the work and wasted in an area to be provided by the applicant with the approval of the inspector. Grading shall be performed as may be necessary to prevent surface water from flowing into trenches or other excavations, and any water accumulated therein shall be promptly removed by pumping or by other approved method. In those areas where the utility is to be installed under subsequent trench settlement must be held to a minimum. If d the method is selected by the applicant the following procedure for backfilling shall be used. Suitable backfill , material shall be placed in the trench in lifts of not more than 6 inches deep. After the backfilling of each lift, water shall be placed in the trench section by flooding, jetting, or other means in such quantities and in such a manner that all portions of the lift become completely saturated. The use of a hose and long pipe nozzle shall be employed to induce settlement and assure complete saturation of the back- -' fill. The nozzle shall be inserted ,at such spacing as necessary to .assure complete saturation and settlement of the backfill. It shall be the applicant's responsibility to determine and ' water-settle- provide the quantity of water rcquried in every case to effect complete water settlement of the backfilled material. Any subsequent settlement of the trench during the applicants guarantee period shall be considered to be the result of improper Gass B backfilling and shall be corrected at the applicant's expense. After all backfilling and water settlement has taken place, the applicant shall supplement the flooding or jetting by the use of vibratory or impact compaction equipment. Vibratory compaction or dcsification may be applied by the use of probe-typ- e vibrating rollers or plates applied to the surface of the backfilled trench, with additional fill material being brought in as necessary. If the mechanical compaction method is selected by the applicant the following procedure for backfilling shall be used. Suitable backfill material shall be placed in the trench in lifts of not more than 18 inches deep. Each lift shall then be continuously and throughly compacted by use of a vibrating compactor used, so that complete compaction and settlement is achieved. Minimum compaction of 92 of maximum density is required for Class B backfill. self-propell- This class of backfill is intended for use in areas where lawnsod, shrubs, topsoil, fences and other items must be removed and replaced during the trench excavation arid backfill operation. The backfill process shall be the same as that for Class B backfill with the exception that the final layers of material to be replaced shall be as specified in Section 5. Gass D Backfill This class of backfill is (4) intended for use in areas which are utlimately to be planted and where minimum compaction (above the pipe zone) is required at the present time. Restoring Surface Restoration shall be commenced as soon as possible followng excavation. Complete restoration shall be diligently pursued until complete. Unless specifically authorized by the Road Superintendent restoration shall be completed within 72 hours of initial excavation of the total area impacted by the excavation. Excavation shall be as specified in Section 3 "Excavation, of this ordinance with the following exceptions: (1) Before trench excavation is begun, any bituminous pavement to be removed shall be cut with a saw or pneumatic tod to provide a straight, neat construction line. (2) Pavement removed during excavation shall be wasted and not be used in backfilling the trench. a.
