OF THE BOARD OF EDUCATION 1974, OF DUCHESNE COUNTY SCHOOL DISTRICT. DU CHESNE COUNTY. UTAH. PROVIDING FOR THE LEVY OF TAXES TO PAY PRINCIPAL OF AND INTEREST ON SAID BONDS, AND PROVIDING FOR THE SALE OF SAID BONDS. IIERLAb at a special bond election duly and lau fully called and held in Duchesne County School District, Duchesne County, Utah, on May 9, 1972, the issuance of $2,500,000 bonds was authorized for the purpose of raising money for purchasing school sites, for building or purchasing one or more school houses and supplying the same with furniture and necessary apparatus, and for improving school property under the charge of the Board of Education, the result of which election was declared by the Board of Education, sitting as a Board of Canvassers, on May 11, 1972; and WHEREAS $2,180,000 of the bonds voted at said May 9, 1972, election have heretofore been issued and delivered, and it has been determined to authorize the issuance and sale of the remaining $320,000 of said bonds at this time; NOW. THEREFORE. Ik It Resolved bv the Board of Education of Duchesne County School District, Duchesne County, State of Utah: SECTION 1. That under authority of Chapter 14 of Title 11. Utah Code Annotated, 1953. otherwise known as the Utah Municipal Bond Act, there shall be issued by said Board bonds in the amount of $320, 000 for the purpose ol raising money for purchasing school sites, for building or purchasing one or more school houses, and supplying the same with furniture and necessary appartus, and for improving school property under the charge of the Board of Education. SECTION 2. That said bonds shall be known as "School Building Bonds, Series March I, 1974," shall he in the denomination of $5,lX)0e;u,h, numliered 1 to 64, inclusive, dated March 1, 1974, shall bear interest from their date until paid at such rate or rates not exceeding eight per cent per annum as shall be fixed by resolution to be adopted at the time the bonds are sold, said interest being payable September 1, 1974. and semiannually thereafter on March arid September 1 of cadi year, and shall fall due serially without option of prior redemption in numerical order on Ma'rch of each of the ears as follows: Bond Numbers Amount Year to 12 $60,000 1975 13 to 24 60,000 1976 25 to 37 65.000 1977 38 to 50 63,000 1978 51 to 64 70.000 1979 SECTION 3. That both principal of and interest on said bonds shall he pavahle in lawful money of the United Stales of America at First Security Bank of Utah, N.A., Main at First South, in Salt Lake City, Utah. Said bonds shall be signed by the President and attested by the Clerk of the Board of Education ithe signature of said President being by facsimile), and shall have the facsimile of the corporate seal of said Board imprinted thereon and shall have coupons for interest attached, which coupons shall be signed with the printed facsimile signatures of the President and Clerk of the Board of Education, ami the preparation of said printed facsimiles of s iM President and Clerk upon said bonds and coupons is hereby adopted by the Board as the authorized and authentic signing of said bonds and coupons by said officials. SECTION 4. SERIES MARCH 1.1974 NUMBER $5,000 The Board of Education of Duchesne County School District, Duchesne County, State of Utah, hereby acknowledges itself to be indebted and for value received hereby promises to pay to the hearer hereof, without option of prior redemption, the sum of Five Thousand Dollars i$5,000) on the first day of March, 19 , with interest thereon at the rate of per cent l i per annum from the date hereof until paid, payable September 1, 1971, and semiannually I hereafter on the first days of March and September of each year, said interest to maturity being payable only upon presentation and surrender of the appropriate interest coupons hereto attached. Both principal and interest are payable in lawful money of the United States of America at First, Security Bank of Utah, N.A.. Main at First South, in Salt take City. Utah. This bond is one of an issue of $320,000 bonds of like date and tenor, except as to maturity (and interest rate), issued for the purpose of raising money for purchasing school sites, for building or purchasing one or more schoolhouses and supplying the same with furniture and necessary apparatus, and for improving school property under the charge of the Board of Education and is issued under and pursuant to the provisions of the Constitution and laws or the State of Utah, including particularly the Utah Munieipal Bond Act, Chapter 14, of Title 11. Utah Code Annotated, 1953, after having been authorized at an election held on May 9, 1972, in said district by vote of the qualified electors of said district. The Hoard of Education of Duchesne County School I listrict covenants and is by law required to levy annually a sufficient tax to pay the interest on this bond as it falls due and also to constitute a sinking fund for the payment of the principal thereof as the same falls due. It is hereby certified, recited and declared that all acts, conditions and things essential to the validity of this bond exist, have happened and have been done, and that every hereof has been requirement of law affecting the issue is within every duly complied with, and that this bond and Constitution the limit by debt and other prescribed laws of said stale, and that the full fail h and credit of said Board of Education of Duchesne County School District are hereby irrevocably pledged to the punctual payment of the principal of and interest on this bond according to its terms. i (1) lAltamont Construction Co. That the President and the Clerk of the Board of Education are each hereby empowered and directed to sign, and the Clerk to cause the facsimile of the corporate seal of said Board to be imprinted on each of said bonds, and the acts of said President and said Clerk in so doing are and shall be the act and deed of said Hoard of Education of Duchesne County School District, Duchesne County, Utah. The use of the facsimile signature of the President on the face of the bonds is hereby authorized. SECTION 6. That all covenants, statements, representations and agreements contained in said bonds and coupons, and all recitals and representations in this resolution and order, are hereby considered and understood and it is hereby resolved that all said covenants, statements, representations and agreements of said school district, are the covenants, statements, representations and agreements of the Board of Education of Duchesne County School District, Duchesne County, Utah. S FICTION 7. That to pay the interest falling due on said bonds as the same becomes due, and also to provide a sinking fund for the payment of the principal of said bonds at maturity, there shall be levied on all taxable property in Duchesne County School District, in addition to all other taxes, a direct annual tax sufficient to pay the interest on said bonds and to pay and retire the same as hereinbefore provided. Said taxes when collected shall be applied solely for the purpose of the payment of said interest on and principal of said bonds, respectively, and for no other purpose whatsoever until the indebtedness so contracted under this resolution, principal and interest, shall have been fully paid, satisfied and discharged, but nothing herein contained shall be so construed as to prevent said district from applying any other funds that may be in the district treasury and available for that purpose to the payment of said interest and principal as the same respectively mature, and the levy or levies herein provided for may thereupon to that extent be diminished, and the sums herein provided for to meet the interest on said bonds and to discharge the principal thereof when due, are hereby appropriated for that purpose, and the required amount for each year shall be included by the Board of Education in its annual budget and its statement and estimate as certified to the Board of County Commissioners in each year. Principal or interest falling due at any time when there shall not be available from the proceeds of said levies money sufficient for the payment thereof shall, to the extent of such deficiency, be paid from other funds of the Board of Education available for such purpose, and such other funds reimbursed w hen the proceeds of said levies become available. SECTION 8. That said bonds shall be sold pursuant to resolution to be hereafter adopted. The Treasurer of the Board of Education is hereby instructed to make delivery of such bonds to the purchasers thereof as soon as may conveniently be after the adoption of the resolution confirming sale and to receive payment therefor in accordance with the terms of sale and to set the proceeds of said sale aside into a separate fund to be used for the purposes for which the bonds are herein authorized. SECTION 9. That this resolution shall he published one time in Uintah Basin Standard, a newspaper of general circulation printed and published in Duchesne County School District, and for a period of thirty (30) days after such publication any person in interest shall have the right to contest the legality of this resolution or of the bonds hereby authorized or any provisions made for the security and payment of such bonds. After such time no one shall have any cause of action to contest the regularity, formality or legality of this resolution or the bonds herein authorized for any cause whatever. SECTION 10. That all resolutions and orders or parts thereof in conflict with the provisions hereof are hereby repealed. With 86 homes already occupied and 71 more nearing completion and expected to be ready for occupancy this month, there is a total of 157, houses on the U & 0 Reservation which has enhanced the standards of living, considerably for members of the Ute Indian Tribe. The homes are made available through the Mutual Self Help Home Ownership, a program of the Urban Housing Development, a low income subsidy. More homes are anticipated being built in the Ouray, Randlett and other rural areas in the future to meet present demands. Starting in March, thirty low rent, and ten homes for the elderly will be constructed on the reservation. Not only are the homes nice looking, well built homes, but sidewalks are laid, streets paved, curb and gutters built and landscaping work done. Another program of assistance to those who have homes and want them modernized or repaired is the Housing Improvement Repair Program where by the UIA receives federal appropriations from congress and then contracts it to the Tribe. Money received for the program sinee 1969 to date is $200,000.00 and approximately 1 19 homes have received repairs from substandard to standard homes. The number of homes on the reservation without the water or sewer or both, number one or two at last count and those are in the process of being modernized. According to BIA officials, every reservation in the United States, qualifies for the same program.
