In checking Article 13 of the treaty..., you will note that the treaty would come into full force and effect 9& days after the ratification by the 20th nation and this occurred on January 12, 1951. This treaty is both national and international law and derives its authority not only under Article 6, Gause 2 (the Supremacy Gause) of the Constitution of the United States but also under the United Nations Charter. As far as the United States is concerned this treaty is Law. It is quite true that the United States rejected this treaty in 1949. as to However, irrespective whether or not the President ratified it by Executive Agreement, or the Senate rejected it or not. the fact remains that twenty other Nations did ratify it. The Treaty thereby became Law making it binding upon the United States as well as all other member nations. Because the United States is a signatory member of the United Nations the Treaty is Law in the United States by virtue of: 1. Ratification of the United Nations Charter. 2. Statute of the International Court of Justice. 3. Enactment of the United Nations Participation Act of December 20, 1945 as amended October T9, 1949. The United States Senate merely exercised its right to either reject, ratify or abstain as to the Genocide Treaty, and did not in any way nullify, or void such treaty or prevent it from being ratified by 20 other member nations. This is exactly what happened January 12, 1951, when the treaty came into force and became law. Be sure to check page 880 of Senate Document No. 87, Reviewvof the It states: United' Nations. Legally, Genocide can mean anything. Almost any act you may commit could be declared Genocide!
