| Show COMPLETE TEXT OF PROPOSITION NO EMERGENCY POWERS AMENDMENT A JOINT RESOLUTION OF THE LEGISLATURE PROPOSING TO AMEND THE UTAH CONSTITUTION: TO CLARIFY EMERGENCY POWERS OF GOVERNMENT IN TIMES OF DISASTER AND PROVIDING AN EFFEC- TIVE DATE THIS RESOLUTION PROPOSES TO CHANGE THE UTAH CONSTITUTION AS FOLLOWS: AMENDS: ARTICLE VI SEC 30 Be it resolved by the Legislature of the state of Utah two—thirds of all members elected to each of the two houses voting in favor thereof: Section I It is proposed to amend Article VI Sec 30 Utah Constitution to read: Continuity in government Sec 30 a) Notwithstanding any general or special provisions of the Constitution the Legislature in order to insure continuity of state and local government operations when such operations are seriously disrupted as a result of natural or man—made disaster or disaster caused by enemy attack the Legislature may: Laj provide for prompt and temporary succession to the ers and duties of publie-offiees-- pow- of any elected or appointed public office the incumbents of which may become unavailable for carrying on the powers and duties of such offices11 and 10-Hfilledllyt4ection-or-appoiertme- o measures necessary and proper for insuring the continuity of governmental operations including but not limited to the financing thereofl but subsections--kuut-Lbj adopt Isueh of-al- it section-shit--II be I (2) Subsection I ) does not permit the these temporary public officers lsatippoittieffil to act or the these temporary measures to be iiiteoffiftweiltion-ef- l contrary to the Constitution and applicable law Section 2 Submittal to Voters The lieutenant governor is directed to submit this proposed amendment to the electors of the state of Utah at the next general election in the manner provided by law Section 3 Effective Date If approved by the electors of the state the amendment 1991 by this joint resolution shall take effect on January 1 -I 2 |
