buildings from E hanson of lot 6 5 block 8 at per rod from A 0 0 8 smith kniffi of lot 6 blowe 8 at per rod from Thomas Mc cosh of lot 7 block 19 from T A dunshee 1040 off of lot 6 block 19 this the same game committee recommended that the bid of bf the salt lake turing Company for the twentieth Tweatie th ward school at a cost coat of be accepted adopted APPROVED the weara wear cornell plans for the sixteenth and twentieth wards were approved and the committee author iced to advertise for foi bids the same committee was directed to accept the plans plane of the twentieth ward as changed by architect kletting for the nineteenth at the hooper site and to pay not more than 1000 for the lame A majority and minority report on the bids for the four room addition to the twentieth ward elicited a warm debate two bids bide one of joy for and another of rife bite for being considered the former was accepted and the committee authorized to close the contract RENAMING SCHOOLS on motion the following names were adopted the eleventh ward bryant the sixteenth ward Jack jackson sOD the nineteenth ward washington A COPY mr newman was requested to procure a certified copy of the records record of the eleventh ward relating to the transfer of the school site to the board AN invitation an invitation fram the salt lake tonto tonic sol fa society asking the board to attend a lecture by A C smith on vocal culture was referred to lotse the committee on school work 9 GRANTED the request preferred to superintendent millspaugh asking thal the school children be invited to bring floral offerings to the committee on decoration lor or may 30 was authorized aut horld to be granted ATTORNEYS Oi OPINION lINION the following opinion from the boards attorneys caused some warm discus discussion siou replying to the oral inquiry of a member of your board as to whether or not where a notice had been published inviting bids to build a specified schoolhouse twentieth and bids had been received the board might under the statute let a contrast cont rapt on one of those bids for another schoolhouse to be built on a different site but of the same size and upon the same plans lans and specifics ions we have to in M that in our opinion the he anten tic tion is that hat I 1 the board shall advy advertise a 6 use ti for each and every schoolhouse proposed to be built and that letting a contract in the t instance suggested would be a violation viol aion of the provision of the statute we are however of the opinion that this provision is directory merely and designed for the purpose of affording an opportunity to obtain the most moat favorable bid however if the school board should build a house without letting a contract or in the manner proposed by iryne still think the construction would LU be legal and that the expenditure for the schoolhouse would not be sub subject atile set to legal objection in other words while the object ol of the statute is obvious it would not preclude the school board from building a schoolhouse if no biawas offered satisfactory or none whatever were made WILLIAMS BILLS APPROVED following bills were approved approve herald company lo 10 25 to part payment to monheim birda bird 00 total 40 ELEVENTH SCHOOL SITE TITLE mr baldwin bald win again called attention to the eleventh school site title and submitted the following opinion by williams for the board board of education gentlemen referring again to the title to the east one half of lo 10 8 3 block 69 59 plat B salt rake lake city survey and in explanation nat ion of our opinion of may may 16 1892 we may state that when this matter was brought to our attention by mr baldwin it was stated that it was the desire of the board to have an opinion w whether heither at the present time it was probable that any person would question the title of the board to this yand it was answering that question that the opinion of may 16 1892 was written while there are technical defects defect as in the opinion of october 11 1899 yet we are of the 0 opinion 1 n ion that the only substantial defect defeat if T it t be considered one is that stated in in the opinion of may 16 1892 WILLIAMS VAN COTT mr van cott being present explained that there were legal defects in the title and it was doubtful whether they could be remedied the all important porta nt question was whether or not the had any heirs under disability another serious defect was that the ecclesiastical board of the eleventh ward did not possess the power to transfer the property as they only held it in trust for the members at large the rho only way to secure a perfect title was to commence suit against all the members of that ward 0 |
