Show amendments TO THE STRUBLE BILL ABOUT three weeks ago we pub dished the text of the measure known as the struble bill which aims to disfranchise all latter day saints in the territory of utah since then the bill has been amended so as not to make an offense of monogamous celestial marriage avoiding a construction which might have been put upon it and the following has been added to the second section a 4 3 any person who shall take said oath shau shall be entitled to have his name me entered on the registry for said ele election but if he swears falsely he shall be deemed guilty of perjury penury and on conviction thereof therea fiala be punished hed accordingly 21 anew A new section to be known as section 3 Is also added as follows that any person of the crime of perjury perjury under the provisions ans of this ac actor c or the act hereby amended d or to which this act is supplemental t 1 shall have the right to appeal upon auy any question or of law or fact to the supreme court of the united states the effect of the clause added to section 2 is to curtail the unlimited authority heretofore assumed by registration officers in pawl passing ng judicially upon the question of an applicants right to take the registration oath under this bill the registrar is made no more nor less than he is supposed on the principles of common sense to be a ministerial of officer fleer he must ad administer the oath to all applicants sf and leave the question of their right to take it to the courts if swear falsely they subject themselves to punishment for perjury the new section numbered three provides for appeals to the highest tribunal in the land both upon questions of law and fact while these amendments might in actual practice tend to mitigate the tyranny heretofore exercised in this territory Perri tory in relation to a tain class clam of prosecutions and the registration of voters they do not in the least modify the infamy of the bill when as al whole it is viewed from a standpoint of principle patriotism or constitutional law |
