Show BEFORE THE commission at 10 on Tuesday Dec 17 J H moyle and B R W young appeared before the utah commission in behalf of the peoples peopled municipal central committee to attend the hear hearing ng of the charges filed by that committee against the registrars of the city mr moyle suggested that mr legrand young another of the attorneys for the committee would be detained in the district court a short time and that if the commission had other business before it it would be agreeable to his bis side to continue the registrars 7 hearing a short time col page here bere announced that he had just been notified by telephone that registrars morris and clute would be wanted in the district court at 11 at gen McClern ands suggestion the commission held a brief consultation when it was decided to go on with the case of mr mccallum on behalf of this defendant mr dickson read an answer containing denials of some of the allegations of the complaint and versions of some of the facts therein stated at variance with the statements of the complaint the commission ruled that it would take up the charges against mr mccallum in their order C J S was placed on the stand he told how he had called on the registrar to we see if his bis name was on the list anti and narrated the conversation that occurred witness was not permitted to see if his name was on the list J 0 B haynes aged 81 years was next he came to lo the united states when a child had lived in U utah tah 82 32 years had been admitted to citizenship many years ago and had voted many years registrar mccallum had bad cnown shown him his name misspelled on th the registration list and had refused to correct it witness thought this occurred two or three months ago mr dickson objected to this testimony for the reason that the incident occurred before mccallum was a registration officer the defense showed witness affidavit to the effect that the id incident eident occurred early in november and also cited the fact that Mc mccollums Callums mccall urns answer confessed the circumstance W witness itress was allowed to state the conversation which occurred and on cross examination said that mccallum told him he must apply to the county clerk to have his name spelled led correctly anti and refused tore to reregister him witness 1 naturalization alim papers were burned on a steamboat on the illinois river about 1880 he had never obtained duplicate papers W T jack of the first ward was wais sworn witness applied on november to me callum to be registered in company with mr greenwald A mr was in mccal lums alums office when witness entered and had bad just asked to be registered request was refused and he left when he had gone mccallum said to greenwald 1 I know him christensen Christen aen hes a d mormon witness heard ask if his name was on the list and if it was not to be registered mccallum refused to grant either request made by christensen but registered witness without objection mr P L williams for the defense tried to show that the incident occurred in Callums mccollums Mc private office while he be was making his hie house to house bouse canvass and was riot not obliged to register applicants at his office mr moyle replied that the incident st stowed showed owed discrimination by the officer in registering one man and refusing fusing ee to register another mr jack had bad gone to the office in company with a well known liberal 11 II jake Greenewald and was registered without question while known to the officer to be a IMor mormon moD was put oft A thos J curtis was next examined knew registrar mccallum was present on dec 2 when a number of men applied to mr mccallum to be registered they first saw mccullum in the street and by his invitation went with him to his bis office on the steps of his office he said that that was his private office and he could not register any of them there A man named smith stopped stepped up and asked to tobe be registered mccallum said lie was going away for a few days when mccallum invited him into the office and then and there registered him smith seemed to be a stranger to mccallum witness bb believed smith to be a member of the Mormon Church and of the peoples party but thought he took no part in church matters joseph woolsey next testified he lived at S third fast east street had applied in the latter part of november to mccallum to be registered it was at the st james hotel saw him register one or two men when witness asked to be registered giving his name mccullum mccallum refused to register him saying that witnesses wife had told him mccallum that witness had bad come to salt lake to vote mccallum became angry and threatened that if 01 witness registered he would have bave him in the penitent penitentiary jary within twenty four hours on cross crow examination witness said he be came to this city in september from kanosh was born in provo had lived in kanosh seven or eight years voted in kanosh last august owned no do property there came to salt lake because he heard there was work here had no recommend from his bis bishop to come was not advised by his big bishop to come knew nothing of other residents 0 of kanosh who had come here had been in the house where he now lived about one month before his wife came eight men besides himself lived there and had been living there about three or four weeks before the registration officer called some of them came from kanosh mr moyle objected to this line of cross examination as it related to other men for whom witness was not responsible mr dickson held it was proper as showing that wit new bess was one of a party who had come to this city for au an illegal purpose a fact that would affect his testimony the point was argued by counsel pro and con and the commission after conferring ruled that eliat witness might be questioned as far as necessary to inquire into his good faith fait in coming to this city this virtually gave mr dickson all the scope he desired and he continued the cross examination eliciting I 1 ng the information that two broth erlof ers of witness wife were in the house where witness lived and that witness knew several men whose names mr dickson mentioned but did not connect with the case witness wife kept house for the men staying there witness obtained work from mr watson on the sewer had no conversation with mr Watson about politics mr moyle objected to questions touching witness work as irrelevant overruled witness did not know watson came to ask him for work because he had been told he was a boss boas on the sewer had inquired of a workman who the boss was did not know who the boss was till he came to this city and inquired witness on being further cross ex testified that he had a house in kanosh for which he owed and that the furniture in it belonged to his wife the eight men at a third east street boarded wath him and his cifes father paid their board did not send for his wife to keep a boarding house much time was consumed in questioning witness about what occurred at the time he applied to mccallum for registration but nothing important was elicited and witness was excused mr moyle asked if the commission issued subpoenas and received a negative reply C J was wag next dext sworn on dec 10 witness made several attempts to find mccallum was in the batters lat office when he be came in mccallum said he could not register him there but would call at his witness house witness replied lied that the neighbors had told him E lm that the registrar regi had already passed his house mccallum then said he could not register witness at k until dec 23 28 cross examined by mr dickson witness was unmarried his parents lived ip wasatch county had been working for a man living in salt lake and came here to get his money con concluded he might as well stay got work on the county road had no talk with any one about coming here to vote intended to make this his permanent home if he could get work here mr moyle that this closed the testimony against mr mccallum Mc mccallum was then sworn and testified in his own behalf every morning before going out on liis his canvass it was witness custom to visit his office mr met him there one morning and asked to be registered had not found in his canvass and told him so go and that he would look for him further told there was plenty of time for hiru him to be registered and that he be worry never checked any mans name liberal or peopled until he had visited his house men had formed a habit of waiting for him as he came out of his hotel and on the morning when he registered smith the usual crowd was waa in waiting he recognized one of them buckwalter and told him his name was che checked ched herd he admitted registering smith as testified to by a previous witness as a matter of accommodation because smith was going aw ay mado amadita it is rule to question closely applicants whom he be did not know regarding their qualifications ficat ions witness admitted the truthfulness of testimony in reference to the name of mr haynes he be stated that his name was erased and rewritten on the list witness told mr haynes he fie would have to be re registered but refused to do so go until haynes should pro duce proof of naturalization regarding the testimony of joseph woolsey witness said he called at 9 third E st at street was met by a woman who said there were ten voters there who wanted to register in the first room he entered there were several rolls of bedding on the floor but no furniture a decoud room contained scanty kitchen furniture the woman said she had been lere there about six weeks and her husband came a month before she did and sent for her to keep a boarding house she promised to give witness the names of all the men next morning and told him they had come to vote next morning he called to get the names when the woman told him that her husband had told her to say to him that the men had not come to vote but to work she did not give him the names of auy any more of the men witness described the row with woolsey denied calling a d n mormon cross examined by mr moyle had refused to register woolsey because he felt confident lie was not eligible woolsey had used offensive language which led to the row had declined to register in his big office if he be knew a man he would register him anywhere but unless he knew any given man was a resident of his precinct and fully qualified would not register him anywhere except at the mans home was equally well wel acqua acquainted in both political parti parties es know knew more liberals thau than peoples peopled party men in bis big precinct had never refused to register any man whom he knew to be qualified but had put off an I 1 indefinite n number whom he did not dot know could not mention the name of any liberal whom he be had refused to register on the street nor of one whom he had bad required to produce proof of naturalization mr mccallum stated during his bis testimony that he considered it his big duty to clakely question applicants for registration whom he end aid not know concern concerning ing their fica tion sand to refuse to administer the oath to them unless he felt satisfied they were eligible his frankness in admitting that he had assumed and exercised judicial functions was surprising A this point a recess was taken till when the examination ot mr mccallum was resumed in reply to mr dickson witness named two liberals 91 whom he had refused to register before dec 23 but admitted on cross examina tion that neither demanded to be registered and that both took witness nessy word that they were not qualified jacob J greenwald testified concerning the registration of wm T jacland the refusal ot of mccallum to register C 1 I Christian feen seD did not hear mccallum speak of as a mcd d d mormon 1 I mccallum refused to register saying he be did not dot know him but registered jack because he did know him witness heard beard all the conversation on that occasion the case against mccallum was temporarily laid wide aside owing to the absence of witnesses and that agai against ast R D winters was begun john A hamilton was sworn had lived in the fourth precinct nearly four years called at mr winters office on november six times and again on the next monday when he met winters on the stairs he asked to be permitted to see if his name was on the list winters replied that the registration was closed but ahat witness name was on the list and checked chairman godfrey asked R W young if lie held that the registrars after finishing their house to house canvass were under obligation to keep their books open till the third week in december mr young replied yes for the reason that only a very few voters were at home when the registrars called 11 chairman godfrey remarked that were this done there would not dot be money enough in the territory to pay the registrars that the other members of the commission might speak for themselves but he did not care to listen to any more testimony OU on this point at this juncture mr dickson read mr winters answer to the charges made against him in which the name of mr moyle was mentioned as trying to control wint winters e rs actions mr moyle took the stand he and W C burton had waited on mr winters and told him that many voters of the peoples party desired dealt ed to be registered and if he would name dame a time when he be would visit a given district they would remain at home winters promised that on that afternoon he would commence on the north tier of blocks in the fifth bishops Bi ward when witness and mr burton said they would notify their friends to be at home mr winters Winter made this proposition freely witness rould not dot say except on information whether wirters had lone done as he proposed mr moyle asked that the affidavit of an absent witness le be received in evidence chauman chairman godfrey said it might be a ba bad 4 P ure to admit an a tioff mr moyle said that as the no authoritative means of securing the attendance of witnesses his side aide were meeting with much difficulty in getting their evidence before the commission chairman godfrey said reasonable time would be given mr moyle to secure the attendance of hlis hia witnesses mr woods was here sworn and testified to the registration of wm T jack and the refusal of mr mccallum to register C 1 I se n was present nt at the time did las r not h hear McC ca alluin in in speak of christ as a I 1 id d n mormon at the close of this witness testimony a discussion ensued regarding the time to which an adjournment should be taken at length 2 pm dec was fixed upon and the commission adjourned dec utah commission continued the examination of the charges against the registrars witnesses not being present in the case of registrar winters it was held over to show that the officer while on his house to house visits had cut through blocks and avoided going to houses where peoples peopled parth voters resided mr winters took the stand on his own behalf and made the following statement concerning mr hamilton who had bad testified to having asked if his name was on the book he said that he remembered that hamilton called on him but he was without his bis book hamilton asked if he had his book but said nothing about his name being on the book concerning what he be had said to mr moyle about the plan of registration tra tion commencing at a certain point in the fifth bishops ward it was strictly followed with the exception that he might not have started to work the exact time mentioned when in conversation with mr moyle he said that he never intentionally missed a house in his precinct but would say that the people many times seemed to avoid him as though he had come to steal something and in some cases they would not let him in the house cruss cross examined by mr moyle he had completed the fourth precinct in october and afterwards taken the city directory to see if any names were missed remembered cutting through |
