The Utah Division of Oil, Gas and Mining contends that the public agency owning the road has the right to regulate the truck traffic on that road. However, the federal Office of Surface Mining has issued three violations to three different mining operations in Emery county for using public roads which federal bureaucrats say do not meet standards set by the federal office. One of the roads questioned is a state road, one is a county road, and the other is owned by the U.S. Forest Service, and some say the three mines were obviously chosen to test jurisdiction.
