The men claimed they did not recognize the bird as an eagle, so they shot it for coyote bait. Federal Judge Willis W. Ritter sentenced each man to 90 days in federally approved prison. The men appealed their sentences in the Denver District Federal Court. That judge upheld Judge Ritter's decision. Eagles, hawks and owls are protected in Utah by state law and eagles are also protected by strict federal regulations.
