Lyman, CPA LYMAN & THOMPSON, CPAs Blanding, Utah , , Property settlements made in conjunction with a divorce can be taxable events in certain situations. State laws vary and they do have bearing on how the property settlement, will be viewed for federal tax purposes. Whether the property being divided is jointly owned, separately owned, or community property, and whether any of the transfer is being done in settlement of marital rights will determine how the transactions wiU be regarded under the tax law. Only by having your divorce lawyer work with your acountant can you be sure to achieve the lowest tax possible for both parties. Legal fees and court costs in connection with a divorce are generally not deductible by either the husband or the wife except for that portion which can be attributed to tax advice. To get a deduction for at least part of the fees paid, your attorney should specify the portion of his bill that is attri- butable to tax considerations. Your tax return filing status will change from matried to single or head of household if you are divorced as of the last day of the year. You are still considered married even if you are legally separated under an interlocutory (not final) decree of divorce. However, certain married individuals living apart may be entitled to file as singles and use the more favorable single tax rates rather than the rates for married, filing separately. To qualify, you must file a separate return, have paid more than half the cost of keeping up your home during the year, have had your child in your home for more than six months of the year, and not have had your spouse living in your home at any time during the year. If you meet all these requirements and had your child living with you all year, you may file as head of household. There are few changes in ones life that do not also create changes in ones tax situation.
