UTAH RESOLUTION NO. 1 A RESOLUTION THE INDECLARING TENTION OF THE CITY OF WEST VALLEY CITY, SALT TO COUNTY, LAKE ESTABLISH A SPECIAL COUNCIL IMPROVEMENT TO PAY FOR DISTRICT THE OPERATION OF STREET LIGHTS IN SUBSUNNVBROOK DIVISION NO. 2 TO VALLEY CREATE WEST CITY, UTAH, SPECIAL IMPROVEMENT DISTRICT 4 TO DEFRAY THE COST AND EXPENSES OF SAID IMPROVEMENT DISTRICT BY SPECIAL ASSESSMENTS TO BE LEVIED AGAINST THE PROPERTY BENEFITTED BY SUCH IMPROVEMENTS: AND TO PROVIDE NOTICE OF INTENTION TO AUTHORIZE SUCH IM- PROVEMENTS AND TO FIX A TIME AND PLACE FOR PROTESTS AGAINST SUCH OR IMPROVEMENTS THE CREATION OF THE DISTRICT. BE IT RESOLVED by the City Council of West Valley City, Utah, that: It is determined to be in the best interest of the City to create a special improvement district to finance the operation of street lights in Sunny-broo- k Subdivision No. 2, the location of which is more particularly shown and described in the "Notice of Intention," herein attached and by this reference made a part of this resolution. The City Council declares its intention to establish a special improvement district to be known as "West Valley City, Utah, Special Improvement District 4." A description of the proposed district is more particularly described in the "Notice of Intention," herein attached. The cost and expense of monthly operation of the proposed street lights shall be paid by a special assessment to be levied on all real property within the district benefitted by the improvements. The assessment snail be levied according to the benefits to be derived by each property within the district. Such assessments shall be made in accordance with Chapter 16 of Title 10, Utah Code Annotated, 1953 as amended. Upon agreement with Utah Power and Light, the system itself and the cost of installation of said system shall be provided and paid for by Utah Power and Light, upon request of West Valley City, after the creation of the aforementioned proposed district. Any person who is the owner of property to be assessed in the proposed district described in the "Notice of Intention" shall have a right to file a writ ten protest against the creation of the district or object to the proposed improvements. Protests shall be filed in the City Recorder's office pursuant to the provisions outlined in the "Notice of Intention" attached hereto. Thereafter, on a date in compliance with State law, the City Council will hold a public hearing in the City Council Chambers to consider all protests so filed and hear all objections relating to the proposed district. The City Recorder is hereby directed to have published the "Notice of Intention," attached hereto, in a newspaper having general circulation in the City once each week for 4 consecutive weeks, the last publication to be at least 5 days and not more than 20 days prior to the time fixed in the notice as the last day for filing of protests. In addition, not later than 10 days after the first publication, the notice shall be mailed, postage prepaid: (1) addressed to each owner of property to be assessed within the special improvement district at the last known address of that owner using for this purpose the names and addresses ap- - pearing on the last completed real property assessment rolls of Salt Lake County; and (2) addressed to "owner" at the street number of each piece of improved property to be assessed. If a street number has not been so assigned, then the post office box, rural route number, or any other mailing address of the improved property shall be used for the mailing of the notice.
