IRS officials recently told the Department of Defense that it could receive a similar ruling imposed on its members like an earlier 1983 ruling that ; applied to members of the clergy. In Revenue Ruling 83-- clergy members have been disallowed deductions of mortgage interest and real estate taxes when filing tax returns when they receive tax-fre- e housing allowances. 3, . The ruling also disallows, deduction of educational expenses allocable to scholarships or Veterans' Administration allowances. The Air Force, along with the other services, the Joint Chiefs of Staff and DOD, vigorously opposed this ruling insomuch as the financial impact on military people would be severe. The Secretary of Defense expressed to the Department of the Treasury his strong opposition to the ruling and asked that it be blocked. If the ruling is applied to military homeowners, their housing deduction could be reduced by an amount equal to housing allowances. If a member's housing allowance equaled or exceeded housing expenses, no housing deductions would be allowed. Treasury officials said the ruling on DOD would affect homeowning members of the military services including the National Oceanic and Atmospheric Administration and the Public Health Service. Further study into the subject is being conducted by the IRS with a completion date not known at this time. In addition, the Department of the Treasury has determined that a comprehensive legal review of the issue whould be made. Air Force officials in Washington said that the ruling, if imposed, would not apply to taxes paid before Jan. 1, 1985. Officials also stated that the Air Staff remains strongly opposed to the application of the IRS ruling to military personnel and will seek DOD sponsored legislation exempting military personnel from such action.
