Fork Special Bond Election Notice PUBLIC NOTICE IS HEREBY GIVEN that on the 10th day of January 1984, the Mayor and City Council of American Fork City. Utah County, Utah, (the "Municipality") adopted adop-ted a resolution declaring its intention to create a special improvement district to be known as American Fork City, Utah Special Improvement District No. 84-1 i the "District"). It is the intention of Cie City Council to make improvements im-provements within the District and to levy special assessments as provided in Chapter 16, Title 10, Utah Code Annotated, ( 1953 J, as amended, on the real estate lying within the District for the benefit of which such assessments are to be expanded in the making of such improvements Purpose The purpose for the proposed Special Improvement Im-provement District is to prepare the American Fork Creek channel in such a manner that it will be sufficient to handle the spring tuti-off. tuti-off. Intended Improvements The improvements to be constructed within the District include the following: Installation of a water channel in the American Fork Creek which will be constructed con-structed of concrete and will be adequate to handle the flow of water during peak water runoff run-off periods Construction Con-struction will include safety fencing. Said Improvements will run the entire length of the property within the District. Estimated Costs of Improvements J he total cost of improvements in the District as estimated by the City Engineer is approximately $500,000, of which the Municipality will pay approximately $350,000, leaiing a remainder of approximately $150,000 which shall be paid by a special assessment to !h levied on a lineal creek frontage basis against the property abut'ing the portions of the creek to be improved. im-proved. Other payment provisions and enforcement en-forcement remedies shall be in accordance with Chapter 16 of Title 10 of Utah Code Annotated, An-notated, (1953), as amended. A map of the. proposed District, copies of plans, profiles and specifications of the proposed improvements and other related information in-formation are on file in the office of the City Engineer who will make such information available to all interested in-terested persons. Method of Assessment The method to be used in equitably assessing property owners within the District for their share of the costs will be calculated on each property's lineal creek frontage based on the benefit to be derived by the property. Once the actual cosIj are determined, the municipality will pay 70 of the costs. The remaining 30 will be paid by the property owners. Time for Fifing Protests Any person who is the owner of property to be assessed in the District described in this Notice of Intention shall have the right to file in writing a protest against the creation of the District or to make any other objections relating thereto. Protests shall ascribed or otherwise identify the property owned by the person or persons making the protest. Protests shall be filed with the City Recorder of American Fork City, Utah, or or before 5:00 p.m. on the 14th day of February, 1984. Thereafter at 6:30 p.m. on the 14th day of February, 1984, the City Council will meet in public meeting at the offices of the City Council to consider all protests so filed and hear all objections relating to the proposed District. To all qualified electors of American Fork City, Utah County, Utah: Take notice that on the 28th day of February, 1984, a special bond election will be held in American Fork City, Utah County, Utah (the "City"), at the places set out below for the purpose of submitting to the qualified electors of the City the following proposition: Proposition Shall the City Council of American Fork City, Utah, be authorized to issue general obligation water control channel bonds in an amount not to exceed five hundred fifty thousand dollars ($550,000) for the purpose of defraying all or a portion of the cost of excavating debris, constructing an improved im-proved channel and installing and con structing related water control improvements along portions of the American Fork Creek: and for payment of expenses reasonably incurred in connection with said excavation and improvements and the authorization and issuance of said bonds, and such additional amount as may be necessary to provide moneys for the refunding of all or part of the bonds authorized hereunder at or prior to maturity thereof including in-cluding the cost of issuance of such refunding bonds; said bonds to be due and payable in not to exceed twenty (20) years from the date of said bonds? The polls will be open from 7:00 a.m. to 8:00 p.m. There will be no special registration of voters for the special bond election, and the official register last made or revised shall constitute the register for such election. The County Clerk will make available, or will cause the registration agents to make availaMe, at the above-do bribed polling places, a registration list or copy thereof listing all registered electors entitled to use such voting place. NOTICE is further given that on February 29, 1984, that being a day not later than ten (10) days after said election, the City Council will meet at its regular meeting place at 5:30 p.m. to canvass the returns and declare the results of said election.
