Show LEGAL NOTICE ORDINANCE NO. 439 AN ORDINANCE AMENDING CHAPTER CHAP-TER 9 OF THE OREM CITY CODE RELATING TO THE OPERATION OF THE OREM CITY CEMETERY. WHEREAS Chapter 9 of the Orem City Code provides for the operation and maintenance main-tenance of the Orem City Cemetery; and WHEREAS these provisions do not adequately meet the present needs of the City of Orem; and WHEREAS certain changes are needed in the current Chapter to meet those needs and to bring the ordinance into conformity with City policy; and WHEREAS the City Council has reviewed these matters and now desires to amend Chapter Chap-ter 9 of the Orem City Code. BE IT ORDAINED BY THE CITY COUNCIL COUN-CIL OF THE CITY OF OREM, UTAH, AS FOLLOWS: 1. Chapter 9 of the Orem City Code is hereby amended to read as follows: Sec. 9-1-1. Definitions. Defin-itions. As used in this Chapter, the following words and phrases shall be defined as set out in this section unless the context clearly requires otherwise: Cemetery shall mean any cemetery owned or maintained by the City for the purpose of receiving the remains of decesed humans. Lot shall mean a plot of ground or gravesite in a cemetery covered herein. Lot owner or purchaser pur-chaser shall mean the owner or purchaser of burial rights or privileges, or the collateral right of use of any burial lot, evidenced eviden-ced by a deed for lot or by proved and recognized descent or devise If onTIhe original owner. Sec. 9-1-2. Name established. The burial ground of the City shall be known and designated as the Orem City Cemetery. Sec. 9-1-3. Cemeteries covered. All cemeteries owned or maintained by the City, or which may hereafter be acquired by the City, wherever situated, are hereby declared subject to the provisions of this Chapter. Chap-ter. Sec. 9-1-4. Only humans to be buried. There shall be no interment in-terment of anything other than the remains of human bodies in City cemeteries. Sec. 9-1-5. Vaults required. It shall be unlawful for any person to be buried in the City cememtery unless the casket is placed in a City-approved concrete or steel vault. No wood shall be used in the construction con-struction of any part of any vault. Exceptions to the provisions of this section may be granted for infant burials only. In such instances, the design and construction of the burial vault shall be approved by the City. Sec. 9-1-6. Right to maintain reserved by City. The City reserves the right to enter upon any lot to perform all work necessary for the care and upkeep of all lots in City cemeteries. Sec. 9-1-7. Disclaimer of City liability for grave openings. Under no circumstances circum-stances will the City assume responsibility for errors in opening graves when orders are' given by telephone. Sec. 9-1-8. Ap-plicability Ap-plicability of traffic regulations. The provisions of the City traffic ordinances ordinan-ces relative to the operation of vehicles and conduct of pedestrians shall be in effect in the City cemetery, except as otherwise modified by this Chapter. Sec. 9-1-9. Permit required to enter or disinter. No interment or disinterment shall be permitted without a permit issued by the City. , Sec. 9-1-10. Animals! prohibited. j No animal shall be allowed in any cemetery j except in the confines of i a vehicle. Any animal must at all times be retained within the confines con-fines of said vehicle while the vehicle remains in the cemetery. Sec. 9-1-11. Registration of burials and disinterments. The City Manager shall designate a Registrar of burials for the City, and before burying any dead in any City owned cemetery, or before disinterring for transportation beyond the corporate limits of the City the body of any person who has been buried therein, the relatives or other persons per-sons having charge of the body shall be required to furnish in writing to the Registrar a statement of death, which shall be recorded in a record kept for that purpose by the Registrar. The' statement shall include the name of the decedent, the place of death, the date of burial and the name and address ad-dress of the funeral director or other person making the interment. This record shall be open to public inspection. inspec-tion. Sec. 9-1-12. Supervisor. The City Manager shall designate a Supervisor Super-visor ove.1 the City cemetery who shall have entire control and superintendence of the cemetery, and shall perform per-form such other duties in relation to cemeteries as may be provided by the laws of the State of Utah or by ordinance, order or resolution of the City Council or by the City Manager. Sec. 9-1-13. Supervisor Super-visor to protect cemetery; duties relating to sales. The Supervisor shall keep in proper repair the enclosure around the City cemetery and prevent its being entered by animals, and so far as practicable prevent the destruction or defacing of any marker placed or erected therein. He shall have charge of the duplicate plat of the cemetery. The Supervisor Super-visor shall, at the request of any person wishing to purchase a lot, point out any which are for sale. Upon the disposal of any lots, or part thereof, the Supervisor Super-visor shall notify the Registrar of the fact. The Registrar shall then prepare a deed, after payment of the lot price City. Sec. 9-1-14. Revision of lots to City. Whenever title to purchased lots reverts to the City, the original deeds shall be filed with the Registrar, and before new deeds are issued covering the property, the original deed shall be canceled or a quit claim deed given and the record so changed. Sec. 9-1-15. Duties of Supervisor relating to burials. The Supervisor shall provide for the preparation of , any grave in the cemetery upon application to him being made by the Registrar. He shall provide supervision for every interment and shall fill up and neatly trim the grave after depositing the coffin and shall fill up and trim all graves that have settled or may hereafter settle. Sec. 9-1-16. Removal of grave decorations. It shall be the responsiblity of the Supervisor to provide for the removal of floral pieces or displays left on any grave as he deems it necessary to the appearance ap-pearance of the cemetery, but such floral pieces or displays shall not be removed sooner than five (5) days after their original placement. Sec. 9-1-17. Supervisor Super-visor to enforce regulations. It shall be the duty of the Supervisor to see that the owners of lots within the cemetery obey all orders, rules and regulations made by the City in regard to the care of the lots and in regard to the erection of fences or other obstructions ob-structions and to enforce enfor-ce all other regulations herein provided. Sec. 9-1-18. Supervisor Super-visor to maintain streets and driveways. The Supervisor shall keep the streets and driveways in the City cemetery in good condition and unobstructed, unob-structed, so that access can be had to any lot. Sec. 9-1-19. Supervisor Super-visor to mark block corners. cor-ners. The Supervisor shall cause a suitable marker to be installed upon the northwest corner cor-ner of each block with the number of the block inscribed thereon. Sec. 9-1-20. Grave markers required. The Supervisor shall inform the owner of any lot or relatives of deceased persons buried in any lot of the requirement to place or cause to be placed a suitable marker with the name of the deceased plainly inscribed in-scribed thereon upon the grave of every person per-son interred therein within thirty (30) days after such interment. All markers are to be installed under the direction of the Supervisor Super-visor and in the manner provided in this Chapter, Chap-ter, and if any such person per-son neglects to comply with this requirement, it shall be done by the Supervisor at the expense ex-pense of the person owning or burying in such lot. All markers shall be placed on a concrete con-crete foundation at least six inches (6") deep and shall' be placed flush with the lawn. Sec. 9-1-21. Other markers. There shall be no monuments or structures struc-tures placed upon any lot other than those provided for in Sections 9-1-20. Sec. 9-1-22. Additional Ad-ditional rules and regulations. The City may, from time to time, publish a booklet of rules and regulations for the convenience con-venience of purchasers of lots in the City cemetery. Sec. 9-1-23. Private improvements prohibited; survey, marking of lots. It shall be unlawful for any person to erect or maintain any fence, corner post, coping, hedge or boundary of any kind upon any lot, street or driveway in the City cemetery, or grade the ground or land thereof. The Supervisor shall, whenever required, furnish the boundary lines of any lots according to official survey, and . shall prevent and prohibit landmarks, and shall prevent and prohibit any grading thereof that might destroy or interfere inter-fere with the general slope of the land. It shall be unlawful for any person per-son to plant any shrubs, trees, lawns, etc., place decorative stones or place any monuments or markers upon any lot or lots in the cemetery without written permission per-mission from the Supervisor, Super-visor, and unless the same is done under the direction and supervision super-vision of the Supervisor. Sec. 9-1-24. Burials outside cemeteries. It shall be unlawful to bury the body of any person within the City, except in public or private cemeteries located thereein, unless special permission is granted by the City. Sec. 9-1-25. Resale restricted. No person who shall purchase any lot within the City cemetery shall sell such lot to any buyer except the City.
