It turns out. however, that they may have only a fraction of the water they thought. Now, those property owners may take the state engineer and the Weber Basin Water Conservancy District, among others, to court over the matter. According to court documents filed in Coalville on Monday, the developer of the Royal Bison Development, Corey Higham. filed a water exchange application applica-tion with the state engineer in July IW. I'nder the application. Higham proposed exchanging six-acre-feet of water rights he possessed under a contract with the Weber Basin Conservancy District for six-acre-feet to be diverted from an underground well for the six lots. The state engineers office granted the request on May 15. 198. The approval gave one-acre-foot of water to the six lots per year. However, Higham was informed four months later by the Utah Division of Water Rights that a well test would be required because of protests to the original application. When the test was conducted in November 1WS, the state engineer's engi-neer's office believed the well was no longer capable of producing produc-ing six-acre-feet of water per year, according to court documents. docu-ments. On June 9. 2(K)0. the state engineer's office downgraded the capacity of the well to 2.7-acte-feet per year, or .45-acre feet per parcel. The court documents allege that the property owners had no knowledee of the test that would ultimately lead to the downgrade of their w ater rights. In 1947. Higham became partners part-ners with Ladd Turner, according to court documents. The two created cre-ated a limited liability company to market the properties. But sometime prior to Jan. 1. 2000. the two men had a falling out and Higham's whereabouts are currently cur-rently unknown. Tanner continued to market the property, but failed to change the water rights title to his name. As a result, all official correspondence correspon-dence was listed in Higham's name. The court documents say the property owners were not aware of the problems with the well. The first the property owners knew there was a problem was on June 9. 21MX).
