Show 2 SPRINGVILLE HERALD Thursday, February 24, 2005 Comments EDITORIAL Everything you want to know about the Legislature is online A few weeks ago I heard a KSL editorial on the radio concerning the proceedings of the Utah State Legislature and that they were on the Internet. When I finally got around to looking online, I was amazed. The daily floor debate is right there on your computer. You can log on and actually watch what is going on from your home or office. Because the Legislature had to move to another buildling this year, as the Capitol is being renovated, it was decided to have a closed circuit broadcast of the daily dai-ly proceedings which are put on the Internet. You can watch what is occurring on the floors of both the House and the Senate! Most of us have not made a visit to the Capitol when the Legilature is in session, so this is a wonderful opportunity oppor-tunity to see government in action. All you have to-do is log onto the Legislature's website at wwwie.state.ut.us, and we encourage everone to do it. What is even more wonderful is the extent of information informa-tion you can get from this website including a Kid's Page. The Kid's Page is complete with games, tour of the capitoLhow ideas get to laws, purpose of the legislature, lots of history, ideas for teachers and so much more! I think we have got a lot more government than representation. rep-resentation. In 1823 the population was about 9,650,000 of us. There were 213 representatives at that time in office. There was one representative for about every 45,305 of us. In the year 1913 there were about 93 million people peo-ple in the United States. There were 436 representatives represen-tatives in the House of Representatives. Rep-resentatives. That got us one representative for every 213,302 of us. In the year 2005, including includ-ing the 5 million illegal aliens that slipped into Texas, there are over 300 million Americans. We still have only 436 representatives in the House of Representatives. That's about one representative represen-tative for every 688,073 of us. Now who among us feels that 1 man can adequately represent 688,073 of us with any degree effectiveness? I personally feel that these representatives are better able to represent their own selfish group interests in-terests to us than they are able to represent us to our government. Don't you think it is time to increase the number of representatives in office, time to reduce their pay, time to remove their extraordinary extra-ordinary health benefits? Why are some backwoods back-woods hicks directing the lives and fates of millions of city dwellers? Don't you think it is time to reduce them to the office of Representative from the throne in which they have forced themselves? Interestingly, they had us take an oath to answer truthfully truth-fully the personal questions, including a constitutionally forbidden religious question. They did not administer an oath to uphold the State and Federal Constitutions, as required re-quired in those Constitutions of all government officers. I presume a juror, while serving, is an officer of the government and should be required to take that oath or affirmation. I would like to serve on a jury and uphold the American system. How can I serve my principles if I have to violate them to get on the jury? I had to honestly tell the judge I would not uphold an unconstitutional law, and that I would put the constitution constitu-tion above her instructions. I tried to say as little as possible, possi-ble, but I cannot lie and still claim my principles. We need a law or an amendment that tells the Jurors Ju-rors the Constitution is above the Judge. Or, at least, we need to read the part that says the Constitution is the Supreme Law of the Land, putting it above the opinions of judges. I don't know how to ask the courts to rule that they are subservient to the Constitution, Consti-tution, and that only the people, peo-ple, through the amendment process, are superior to it. I suspect most judges believe the Constitution is whatever the Judiciary says it is. I know that tradition goes way back to 1803, but, as Jef Fracturing effects of charter schools Clara Matthews A new charter school opened in Draper this year. Approximately 60 students out or about 1000 from Draper Drap-er Elementary enrolled m this school. Because all of the funding followed those students, Draper lost its computer specialist, spe-cialist, half-time physical education ed-ucation specialist and four extra classroom support aides. The teachers have lost this released time that was used for planning and giving extra individual help. They must also plan to spend extra time either before or after school at the copy machines. Ten of the easiest special education students were enrolled en-rolled in the charter school. They are being served by parent volunteers, and Draper Drap-er lost one of its special education edu-cation aides. Draper now has about 60 special education students including all of the more challenging ones. The charter school selected its students by lottery, but the parents must provide transportation. Car pools are suggested. An adult and a vehicle must be available to provide this service. This requirement re-quirement greatly reduces the number of single parent The Springville Herald Customer Service 375-51 03 489-5651 Fax 489-7021 239 L 400 S. We need to instruct our judges to tell the jurors to hold the Constitution Consti-tution first, no matter how else they are instructed. Remember Nuremberg? Following orders is no excuse ex-cuse for violating fundamert-tal fundamert-tal constitutional andor personal per-sonal morals. I think we've got jurors violating the Constitution Con-stitution because they are ordered or-dered to do so. Can any lawyer out there think of a lawsuit we might take to the Supremes? ; As a rejected juror, I might have standing. There must be a way to restore the jury as a defense against tyranny, as claimed by our Founders in the Federalist Papers. As it now stands, the Judiciary has usurped all the power to determine the law. Juries are only allowed to determine the facts. ; I know the Founders intended in-tended the Jury as a last line of peaceful defense against tyranny. Now, it's gone. Can we get it back? I doubt the Supreme Court will rule that they don't have that ultimate power. Maybe we need an amendment to give that power pow-er back to the jury. Just rambling. Sorry. But, I am upset at the way my country has been lost to judicial judi-cial tyranny. Maybe someday some-day you should publish some of the statements by Jefferson, Jeffer-son, warning of this very danger. If you are interested, I would be happy to supply a page or two of quotes. I want my America back. Ken Larsen Salt Lake City kencanxmission.com and two-income families who are able to enroll students. There is no lunch provided at the school Families whose children depend on free and reduced lunch will not be likely to enroll in this charter school. The parents are required to volunteer time to the school. This means that someone from the family must be available to donate time, probably during school hours. There are no special services ser-vices available at this school. Any student with a significant signifi-cant problem that requires special education services won't get them at this school. The effect of these policies on the charter school student body is that most students come from highly committed families, most of whom have average or above incomes and students with few academic acade-mic problems. It also means that the public school now has a population with a slightly higher percentage of difficult students, and fewer parents who are willing or able to volunteer to help at school. How does this not hurt the students and teachers left at Draper Elementary? Proponents Propo-nents of school choice and tuition tu-ition tax credits would say that this charter school is open to all students. This school has also reduced re-duced the resources of the public school and at the same time increased the average difficulty of its student body.
