Show Defense Announces That It lias Only To f lore Witnesses to Examine and These Are Insanity Experts; No Testimony Yet Offered to Shov That Prisoner Is Sane Today; Mother Wanted to Testify Regarding Hereditcfy Insanity. , . NEW YORK, March 7. A death in Justice Fitzgerald's Fitzger-ald's family has postponed the sessions of , the Thaw trial for a day, and court will not sit today. . Friday, when court reconvenes, the defense de-fense will call more alienists, probably Dr. Graeme ' M. Hammond and Dr. Smith E, Jelliffe, who have been in the courtroom practically every day since the trial began. Before Be-fore the, court adjourned yesterday Delmas, leading counsel 1 for the defense, stated that there would be only two more witnesses called. The attorneys are devoting today to forming; the hypothetical question which they will put to these experts. This question, . said 'Delmas last night, will cover every fact in the case. How long it will take Jerome to cross-examine these experts no one., can telL It will depend very largely on their attitude atti-tude and their willingness to give direct di-rect aaswers. This decision makes it certain that a number of the witnesses who have been expected to testify for the defense will not be called, at least in the preienta tfon of the fllrect . Among- these are Rojer O'Meara, Thaw'a Pittsburg de-tctlve de-tctlve friend, and May McKencle, Mrs. Bvelyh Nesbit Thaw's chorus girl friend.' Both may be called when the defense reaches lta sur-rebuttal, but It now seems doubtful If they will be called even then. The plans for the defense In regard to what Mrs. William Thaw, the . white-haired white-haired mother of the defendant, would testify to were changed. It had been announced an-nounced that she would testify as to insanity in-sanity in her family, but Delmas would not allow her to do so even after she anked In open court to be allowed to. This was probably due to the fact that the defense does not desire to pile up any more evidence of the taint of insanity in-sanity In Thaw'a blood. Mrs. Thaw's testimony tes-timony as to the mental condition of her brother and other members of her family could do nothing but tend to show that the taint in the blood Is one that would perhaps be permanent. The, defense goes on the theory that Thaw .was insane in-sane from early In 1903 until after June 25. 1906, but that after White, the man whom he believed to be responsible for all his troubles, was dead, his mind rapidly became normal. The defense has not yet Introduced testimony tes-timony to show that Thaw is sane today, but may do so by the experts who are to go on the stand Friday. The only evidence evi-dence that has so far been Introduced which tends to show that he Is at present sane. Is Dr. Evans' testimony that when (Continued on Page 4) the Tombs today and announced her intention of remaining as long as the prison rules permitted. Mrs.' William Thaw, Mrs.- Carnegie and the Countess of Yarmouth also called.- Thaw received' the usual large number num-ber of letters. A number of them eame from- foreign countries. THAW CASE. J "So far as we women are concerned, we consider the worst over," said Mrs. Evelyn Thaw today. 4 ' We are all greatly great-ly relieved that Harry's mother testimony tes-timony has been given. The suspense of waiting to be called bore very heavily heav-ily upon her, and all of us are happy to know it is over." I Mrs. Thaw called on her husband tn , |
