Show VOTES ARE EXCLUDED Supreme Court Rules in the Denrer Election Fraud Case. DENVER, Dec. 14. The., State Supreme Su-preme court today sustained the motion made by the attorneys for the Republican Republi-can party to enjoin the Denver election commission from including In its official abstract of votes the' returns from precinct pre-cinct 8 of ward 7. Chief Justice Gab-bort Gab-bort announced the decision. In which Justice Campbell concurred. Justice Steele dissented and remarked that the action was "unwarranted, unprecedented unprecedent-ed and directly contrary to law." In announcing the decision Chief Justice Jus-tice Gabbert said that the evidence showed that false ballots had been substituted sub-stituted for the genuine ones in this precinct pre-cinct and It was the right of the court to prevent he consummation Of the fraud. Written opinions will be filed later. The decision announced today is said to establish a precedent, and the Republicans Re-publicans will ask for similar action In regard to all precincts in which the Supreme Su-preme court took original jurisdiction at the election and in which it is alleged frauds were committed. There are about fifty such precincts. The court announced an-nounced that motions to throw out the votes of other precincts In which frauds have already been proved will be considered con-sidered tomorrow. By throwing out Democratic precincts In question the entire en-tire Republican Legislative ticket in Denver may be elected, and Adams' 5000 majority over Peabody for Governor in this county may be wiped out. The hearing of contempt charges was resumed today by the Supreme court, the case from precinct 2, ward 7. being taken up. The defendants are Leonard Rogers, Democratic candidate for the State Senate; Frank W. Lee. police captain; cap-tain; Michael Geary. Constable; William Wil-liam G. Adams, Louis Hamburg and John P. Kendrtck. The complaining witness Is Jay Cook, Jr.. Supreme court watcher. The prosecution presented evidence ev-idence tending to show that there was repeating and ballot-box stuffing and disturbances at the polls, for which the defendants were responsible. |
