S. Watson In his place of business In this city, on November 8, 1902, was begun In the District court before Judge Morse this morning. ; Judge King and Judge Truman, coun sel for the defendant, were on hand as i well as Judge Powers, who will assist I District Attorney Elchnor In the prose- i , cutlon. After two minor casea had been j disposed of Judge Morse Issued an or- der for a special venire of fifty, returnable return-able tomorrow morning at 10 o'clock. The work of examining the Jurors who were passed on their statutory qualifications qualifi-cations yesterday was commenced, Judge King for the defense opening the examination. The defense of the accused will be either Insanity or Justification under the statute, Justifying the talcing of life when an attempt at defilement is made. Judge Powers resisted the challenge of Judge King, who asked that Bam Itaney be excused because he was prejudiced pre-judiced against the defense of Insanity. In resisting the challenge Judge Powers Pow-ers said that nothing had been given out that the defense of Insanity would be Interposed. The court excused the Juror. Of the twelve Jurors In the box six were examined and five were passed for cause by the defense. Bam Itaney being challenged and excused. Ellison, who is but a boy In appearance, appear-ance, was attended by his mother, Mrs. Mattle Payne. Ellison seemed Interested Inter-ested In the examination and kept his eyes upon the men in the Jury box. His mother wore a heavy veil and only now and then raised her eyes. She turned around several times to speak with her eon. Court took a recess at 12 o'clock until 2 this afternoon and excused all the witnesses In the case until tomorrow at 10 o'clock. |
