I SCARCE AS HEN'S TEETH third Panel of Talesmen Exhausted; With Only One J - Jufof Passed for Cause; Special Venire. . and had seen blood on the sidewalk he was not of unprejudiced mind; Herman Grether, who was subpoenaed as a juror in the Mortensen murder trial and excused ex-cused for cause was prejudiced against a man who engaged in the liquor business; busi-ness; the challenge of the defense was resisted by the State but sustained by the court. The names of the special venire ordered or-dered are as follows: J. D. Wallace, Arthur B. Margetts, Heber C. Cook, William Knight, Henry Frost, Walter E. Kelson. Ed McClelland, I B. Powell, John P. Turner, Henry Wallace, Frank L. Gardner, Isaac Hadley, L. E. De-spain, De-spain, F. B. Huffman, James L. James, Henry Kirkman, Fred Brain, Joseph A. Wagstaff, E. H. Pierce, Thomas H. Nott, George Bates, Samuel C. Dallis, O. E. Hartwell, Glen Bagley and G. M. Gardner. The third venire f Jurors was ex-hausted ex-hausted this morning in an attempt to secure eight '. unbiased men to try the case of the State against. Miles W. Romney. charged with murder in the second degree. The names in the Jury box bad all been called by 11:15 o'clock this morning, and upon motion of District Dis-trict Attorney Elchnor, an order was made by Judge Hall for another special venire, of. twenty-five talesmen, returnable return-able at 3 o'clock this afternoon, until which time the case was continued. The following were the men In the box who had been passed for cause when court opened this morning: C. E. Bennett, Hyram Seal. D. C. Burrows, William Cutler,. Thomas J. Brldwell, William R. Andrew and Arthur L. Davis. Da-vis. The last named Juror was ex-cased ex-cased by the court on account of 111-. 111-. health. Of the ten men examined one was excused ex-cused by the court to attend to his business, bus-iness, eight were excused upon the challenge of the defense and only one vjas passed for cause. The State and the defense have only five peremptory challenges left and it Is thought that the Jury will be secured before tomorrow tomor-row noon... H. A. Morrison, a newspaper newspa-per advertising man, was excused by t&e court, his duties being such as to require his continuous attention. J. N. Kbuckey, the only one passed for cause, is, one of the most intelligent Jurymen yet examined. It was brought out in questioning him that he had served nine years as a secret service man. Of the others who were excused by the defense. de-fense. Charles C. Buckle had an opinion opin-ion on the merits of the case; Ernest lAyton had a fixed opinion as to the guilt or innocence of the defendant; J. M. Campbell, who first heard of the hooting from a brother of Capt. Bur-btdge Bur-btdge of .the Police department, also had an opinion as to the merits of the case, as did S. B. Mllner; J. B. Strickley aid he had an opinion in the matter that could not be changed by evidence, no matter how strong it might be; C. M. Hansen had read of the affair In the newspapers and from those accounts had formed ah opinion that evidence cpukl in no way affect; Arthur Hulbert had talked with the crowd on Second South street on the day of the shooting |
