Satur-day. Throughout the day's proceedings Orchard Orch-ard maintained a very nonchalant demeanor, de-meanor, excepting upon two occasions. There were two pieces of testimony which attracted his marked attention. They seemed to disturb him, and they aroused noticeable special interest on the part of his attorney. These were two statements by J. H. Hutchinson, one with reference to the finding of the piece of flshllne. the other that respecting the towel on the door knob, covering the keyhole. key-hole. The intense Interest shown by Orchard when Hutchinson told of the piece of flshllne being found was rather suggestive. sugges-tive. While it may or may not have meant anything, the circumstance attracted at-tracted attention because of the theory that the tomb was pulled off by the use of a flshllne, and that the murderer pulled the flshllne in after him as he escaped from the scene. It is) quite difficult to understand the rather excited interest the accused and his attorney took in this feature of the day's proceedings. They seemed disturbed dis-turbed and it was some moments before the prisoner regained his customary air of disinterestedness. The manner In which this testimony was received has act some of those connected with the case to thinking. It seems they believed the towel was of more significance than has been generally supposed. The thought that struck those who heard the evidence respecting the towel was that it was filaced there for the purpose of preventing prevent-ing any one from peeping through to see what waa going on outside. Many people here were considerably surprised to learn that Attorney H. E. Wallace, a close friend of the late ex-Oov. ex-Oov. Steunenberg. living at Caldwell, had consented to assist Miller in defense of Orchard. It was thought Miller would have great difficulty In securing associate counsel, at least at Caldwell, where feeling feel-ing against Orchard is Intense. The preliminary pre-liminary examination of Orchard was resumed re-sumed at 10 a. m. Monday. |
