Show TEXT OF COMPLAINT IN INJUNCTION SUIT AGAINST PRESIDENT Grave charges are made against President Joseph F. Smith, head of the Mormon church, in a bill for ai injunction injunc-tion filed late yesterday evening In the Third District court, The complaint which is filed in the name of Don Carlos Car-los W. Musser and Charles A. Smurthwaite, Smurth-waite, declares that President Smith is diverting . $500,000 annually from the $1,000,000 received, by the church in tithes and gifts, to his own use and for the use of church favorites. It is asserted as-serted that the money is used for the church favorites and President Smith, personally, to- buy residences and stocks in various corporations. The court is asked to enjoin such use. Zane & Strlngfellow are the attorneys. Mr. Musser was one of the persons who raised his hand in protest against the confirming of the apostles at the conference. C A. Smurthwaite lately figured In excommunication proceedings proceed-ings in the church courts. . - Still graver charges are made against the church officials In a statement made by Mr. Musser. . He asserts that President Smith and Apostles F. M. Lyman, M. F. Cowley and J. W. Taylor Tay-lor are violating the laws of the land by cohabiting wljth plural wives. He says that Reed Smooi should not be retained re-tained lc the Senate, as the positions of Senator and apostle are incompatible. An appeal has been taken by Mr. Smurthwaite from the excommunication excommunica-tion proceedings against him in the high council of Weber stake, thus he technically retains membership in the church.
