Show ORDINANCE NO - AN ORDINANCE OF SPRINGVILLE, SPRING-VILLE, UTAH COUNTY, STATE OF UTAH, PROVIDING PROVID-ING FOR THE REGULATION OF DOGS AND MAKING IT A MISDEMEANOR FOR OWNERS OWN-ERS OF DOGS TO PERMIT THEM TO RUN AT LARGE AT NIGHT AND FIXING A PENALTY PEN-ALTY THEREFOR. BE IT ORDAINED BY THE CITY COUNCIL OF SPRINGVILLE SPRING-VILLE AS FOLLOWS: tacking, chasing, or worrying any domestic animal having a commercial commer-cial value or attacking domestic fowl or while such dog is being pursued thereafter. SECTION ni. DEFINITION OF TERMS. For the purpose of this ordinance the term "to run at, large" shall mean and apply to all dogs within the corporate limits of Springville City that are off the premises of the owner or person in charge of the same unless accompanied ac-companied by and in the presence pres-ence of said owner or person charged with the custody of the visions of this ordinance shalt be guilty of a misdemeanor and upon conviction shall be fined in any sum not less than $5.00 nor more than $100.00 or by imprisonment in the city jail for a period of not less than 5 days nor more than 100 days or both such fine and imprisonment. SECTION VI. If any section, sentence, clause, or phrase of this ordinance shall for any reason be held to be unconstitutional by any Court of competent jurisdiction such decision shall not affect the validity of the remaining nnrtinno SECTION I. DOGS RUNNING I AT LARGE PROHIBITED. It shall be unlawful for the owner of any dog or for the person having custody or control of any dog to allow the same to run at large within the corporate limits of Springville during the hours of from one hour after sunset of any day until the hour of sunrise of the following day. SECTION II. KILLING LICENSED LI-CENSED DOGS PROHIBITED. It shall be unlawful for any person to kill or cause to be killed any dog licensed as provided by ordinance ordin-ance without the consent of the .owner thereof except that any per-son per-son may kill a dog while it is at- lM" m TMWlHi I'l.ll. It shall be unlawful un-lawful for any person to kill or cause to be killed any dog licensed as provided by ordinance without the consent of the owner thereof except that any peace officer of Springville City or the duly appointed ap-pointed dog tax collector in Springville City may kill any dog allowed to run at large in violation viola-tion of this ordinance and as in this ordinance prohibited, if in the judgment of said peace officers or dog tax collector it is necessary to maintain and protect the safety, safe-ty, peace, and property of the inhabitants in-habitants of Springville, Utah. SECTION V. PENALTY. Any person violating any of the pro- or sections of this ordinance. The city council of Springville hereby declares that it would have passed this ordinance and each section, clause, sentence, or phrase thereof irrespective of the fact that any one or more sections be declared unconstitutional. SECTION VII. It is the opinion opin-ion of the Mayor and City Council that in order to protect the peace and property of the inhabitants of 1 Springville City that this ordinance ordin-ance shall take effect immediately upon its passage and publication.
