' In his statement of yesterday afternoon Borich a i tested that he first met Mrs. Atkin in Pioneer park last July, making a casual acqua intauce. He said that he had in his pocket lit era t u re given him by William Bowman, agent of the Fidelity Insurance society, and that Mrs. Green came aeross it in the course, of their acquaintance. Mrs. Atkin, the man testified, suggested, upon finding the insurance booklet in his pockt t. that, lie should pa y fi.r a policy for her. saying that lie could get the money if she. should die. He, according to his statement, agreed and made the necessary arraniiemriits, receiving the policy with instructions to turn it over to Mrs. Green. He said that he sat in an anteroom while Mrs. Green was examined by tiie company's physician, but did not hear any of Li'.e conversation between her and the physician. The deposition was taken by order of Judge P. C. Evans of the Third district court upon the application of counsel for the estate, of Mrs. Atkin. It has not been rieetrmined yet whether settlement of the insurance matter will he with or without court procedure. In any event, the testimony testi-mony of Borich Is preserved and available avail-able for reading into court record, if occasion occa-sion be, after he Is executed for his crime, should the board of pardons refuse to extend ex-tend clemency. |
